MINUTES <br />City Council <br />October 26, 1988 <br />Stanke It was noted that a public hearing on the improvement cannot be <br />Impr~ovement schedul ed unti 1 November~ 23r•d i n or•der~ to meet State r•equi r•ements <br />Petition for issuing notices of the hear•ing. <br />(Cont.) <br />Stanke asked if he could install a 30 foot apron with curbing along <br />the r•oad in or•der• to keep driver~s on the r•oad and off his property. <br />Stanke asked if the r•oad was not a City str•eet, if it could be blocked <br />off. <br />Fahey r~eplied that the str•eet is a public str•eet, however, the City <br />did not accept it because the City was not goinq to assume liability <br />for~ the wa.y it was built. Fahey stated that there will be continual <br />problems with the r•oad because of the way it was constr~ucted. Fahey <br />felt any over~lay should be assessed against the benefited proper~ty <br />owner•s at 100%. <br />The City Engineer pointed out that the entir•e length of the road is not <br />bad, just a 500 to 600 foot section. The Engineer~ suggested that he <br />can get ss~ecs pr•epar•ed and have bids r•eady for~ consider•ation at the <br />public hear~ing. Nowever, the Engineer did not know if ther•e would be <br />time to yet the improvement done this fall. <br />The City Engineer suggested that the bumps could be gr•ound down this <br />fal l wi th the over•1 ay done i n the Spr•i ng, si nce the gr•ound wi 11 fr•eeze <br />over the winter months. However, the City Engineer stated that he would <br />like to take another look at the str~eet. <br />Stanke still expressed concer~n with people dr•iving over• his pr•operty <br />and asked if he could take steps to prevent this. <br />Fahey suggested that this be looked at as par•t of the public impr•ovement. <br />Fahey thought that concrete curb stops or~ cur•bing could be installed. <br />Collova pointed out that anything done to keep dr•ivers on the r~oad, such <br />as installation of curb stops by Stanke would have to be done on the <br />Stanke pr~operty and not on the str•eet r•ight-of-way. <br />Mr•. Blesener• introduced the following resolution and moved its adoption: <br />RESOLUTION N0. 88-10-462 - CALLING FOR A <br />PUBLIC HEARING FOR NOVEMBER 23, 1988 TO <br />CONSIDER THE IMPROVEPIENT OF RYAN DRIVE AS <br />PETITIONED FOR <br />The for~egoing r•esolution was duly seconded by Mr•. Fahey. <br />Ayes (5) Blesener•, Fahey, Scalze, LaValle, Collova. <br />Nays (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 20, Page 477. <br />Page -13- <br />
