MINUTES City Council October 26, 1988 Yaggy RESOLUTION N0. 88-10-465 - APPROVING Colby THE CONTRACT SUBP4ITTED BY YAGGY, COLBY (Cont.l ASSOCIATES FOR A PIARKETING STUDY OF THE COUNTRY DRIVE AREA The foregoing resolution was duly seconded by Mrs. Scalze. Ayes (5) Fahey, Blesener, Scalze, Collova, LaValle. Nays (0). Resolution declared adopted. This r~esolution appear~s in Resolution Book No. 20, Page 480. Yaggy Colby indicated that they will make a presentation of their• study to the Economic Development Committee as well as the City Council. Fahey suggested that the issue of the Rice Street study be discussed further with the Economic Development Committee. Round Lake Mr. Jay McNabb, attor•ney r•epr•esenting r•esidents of the Round Lake Tr~ail Tr•ail Townhomes, appear•ed befor•e the Council and repor•ted that since the last Townhomes Council meeting at which the concer•ns of the r•esidents of the townhomes was discussed, and at which time the Council declared that no occupancy Agenda permits would be issued until these concer•ns are r•esolved, a new tenant Addition has been moved into one of the townhome units. The City Cler•k reported that P1r. Schr•ier has now submitted a letter of credit to the City in the amount of $11,000 for completion of the landscaping wor•k at the townhomes. Collova reported that the Building Inspector• has discussed the situation with Mr. Schrier who assured him that the landscaping will be completed. Collova reported that today ther•e was a landscaping firm at the townhomes beginning the work. Collova r~eported that Schrier• indicated that the landscaping will be completed this fall. Fahey asked if in view of the landscaping work pr•oceeding and in view of the letter~ of credit which the City now has, if the r•esidents of the townhomes want the City to evict the resident who moved in without an occupancy permit. McNabb agr~eed that this r~esident was an innocent party. However, the greater concern is the lack of action by Mr•. Schrier. McNabb also pointed out that a full r~eport was to have been obtained on the condition of the r~etaining wall, and the DNR and Watershed have indicated that no r•eport has been requested by the City. McNabb also reported that ther~e are people scheduled to move into the townhomes on November lst, and it was his opinion that the landscaping would not be completed by November lst. page -15-
