P1INUTES City Council Jan. 11, 1989 Nor~th Star~ a place of shelter or appr~oved evacuation plan to a reasonable Mobilehome shelter for• its r•esidents and the plan must be appr•oved by the Park local City by Mar~ch 1, 1989. (Cont.l Husnick again pointed out that he agreed to a trade-off with the City that in r•eturn for a second access to the par•k he would not have to provide an on-site stor•m shelter~. Hus nick pointed out that the access cost $35,000. Fahey replied that the City has now been charged with enfor•cing State Law which was not in effect at the time the second access issue was r•esolved. Fahey asked what will happpn if the plan for the park is not approved by March lst. The City Attorney replied that the State Health Depar•tment would be notified and they would r~equest the County Attorney to abate the unlawful operation of the mobilehome par~k. Fahey stated that a copy of the State law will be provided to Husnick along with any past Council meeting minutes that are located. Fahey suggested that the matter be tabled for two weeks to give Husnick an oppor~tunity to r~evise the plan for• the mobilehome par~k. Other•wise, the plan will be denied and the State Health Depar•tment and County Attor•ney infor•med. A r•esident of Fr•idley Terracz Mobilehome Park outlined the situation in the park she r•esides in which also involved access pr•oblems. Husnick pointed out the issue of liability insurance and its high cost. Fahey pointed out that any shelter that the par•k owners might constr•uct would have to meet the standarcis of the State Health Department. The City will use these standar•ds as well. Husnick again raised the issue that apar•tment owners ar~e not being required to provide stor•m shelters. Scalze pointed out that this matter was debated by the State Legislature and the debate was concluded. This City has now been charged with enfor~cing the State law. Fahey felt the plan should be r•ejected at this time and the ball should be put in the park owner•s cour•t to comply with the Law. Husnick pointed out that he is out-of-town quite a bit. The Council pointed out that there are other owner•s of the par•k and suggested that Mr. Husnick get together• with these partners to resolve the situation. The Council pointed out that it is the park owner~s' responsibility to develop an adequate plan. Any information the City can provide to the owners will be provided. Page -9-
