Ordinance The Mayor opened the Public Hearina to consider the adoption of ~rdinance No, 311 No. 311 which eliminates the requir•ement that non-confor•ming sians be br~ought into confor•mity within a certain time period. Fahey pointed Agenda out that the reason that this Ordinance is being pr•oposed, is that Item No. 8 this section of Ordinance is largely ignor•ed and not enfor~ced. Scalze suggested that if the Ordinance is being ignored, perhaps it should just remain pointing out that there ma,y be a cir•cumstance wher~e it is needed. Scalze pointed out the situation of the billboar•d on High4~ay 36. The City Pldnner pointed out that if the City r•equires this billboar~d to be removed, the City may have to pay the owner•s to take down the billboar•d. The City Clerk reported that PRN DOT may refund for the elimination of billboards. The Council suggested that action on the Ordinance be tabled for• 30 days to give the City Cler~k an opportunity to r•esearch whether or not MN DOT would pay for the elimination of the billboard on Highwa,y 35. Mr. Blesener introd.uced the following resolution and. moved its adoption: RESOLUTION D10. 89-1-32 - TFlBLING ACTION ON PROPOSFD ORDINAPICE N0. 311 FOR 30 DAYS IN ORDER TO GIVE THE CITY CLERK THE OPPORTUNITY TO INV~STI6ATE WITH MN DOT THE SU6JECT OF COMPENSATION FOR THE FLIMINATION OF BILLBOARDS The foregoing resolution was duly seconded by Mrs. Scalze. Ayes (5) Blesener, Scalze, Collova, LaValle, Fahey. Nays (0). Resolution declar•ed adopted. This r•esolution appears in Resolution Book No. 21, Page 34. Rezoning Fahey repor•ted that the Planning Commission recommended appr~oval of Frank Frank Fr•attalone's request to rezone his proper~ty on Spr•iace Str•eet Frattalone fr•om I-P to I-1 leaving the 253 foot depth of pr~operty on South Owasso Pr•oper•ty zoned I-P. Agenda Fr•ank Fr•attalone appear•ed before the Council and submitted a site plan Item No. 10 showing the r•ezoning request as he has pr•oposed. Page -11-
