MINUTES <br />City Council <br />Jan. 25, 1989 <br />Cellular• One Car•r•oway reported that other• companies have their own cell sites, and <br />(Cont.) calls fr•om customer•s of other companies are sometimes tr~ansmitted <br />over Cellular One's equipment when vehicles leave the other companies' <br />cell sites. Ho~vever, Cellular One then bills the other companies for <br />the use of its equipment. <br />Dlesener• pointed out that the City Attorney has r•evised the contr•act <br />that was submitted. by Cellular One for the use of the water tank. <br />Blesener~ pointed out that the issue of liability was addr~essed with the <br />City Attor~ney r•ecommending that Cellular• One have a$1 million liability <br />policy. <br />The City Attor•ney r•epor~ted that he based this recommendation on what <br />two other cities have requir•ed. <br />Carroway reported that other cities have required the $1 million coverage, <br />and Cellular• one has no pr~oblem with that r•equest. <br />Scalze pointed out that the contr•act addr•esses the exclusive lease of <br />the tower for~ the tenant. <br />The City Attor•ney pointed out that the lease states that no other• leases <br />can be made which would interfere with Cellular-One's oper•ation. Nowever, <br />other leases ar~e not absolutely banned. <br />Fahey agreed that the lease should not be an exclusive one. <br />Carroway reported that Cellular One's concer•n would be a matter• of <br />inter~fer•ence and would not agree to other equipment being placed <br />directly in front of their~'s. However, other equipment that would <br />not inter•fere with Cellular• One's would be acceptable. <br />Collova recommended that Cellular One be r•equired to submit a landscaping <br />plan to the City. <br />Fahey asked if ther•e was anyone fr~om the general public pr•esent wishing <br />to comment. <br />Car•1 Swanson asked if Cellular• One was a subsidiar~y of U.S. West or <br />another major• company. <br />Car~roway reported that Cellular• One was not a subsidiary of U.S. West <br />and was in competition with that firm. Car•roway r•epor~ted that McCaugh <br />Communications was the major owner• of Cellular One <br />Swanson asked how many cellular• companies there wer~e in operation. <br />Carroway r•eported that the FCC only grants two carrier• licenses. One <br />license has been granted to AT & T and the other to a public/private <br />corporation. Carroway reported that Cellular One is a public/private <br />cor~por~ati on. <br />page -5- <br />
