L~lesener stated that he would aqree to a siqn heinht of 25 to 30 feet for~ business located along a fr•eeway, however, anticipated var•iance requests as a result from businesses located just outside the distance requirement. Scalze asked how the City will respond to McDonald's pointinc~ out that their variance request had been denied. Blesener• pointeA out that this was a different situation since McDonalds was requestin~ a variance for siqn size on a piece of property they were qoinq to purchase along Highway 36 in order to erect a sign to advertise their~ business. Scalze felt that this would not be the end of the issue, and there would always be a business cominq in asking for a little hiqher or laraer siqn. Fahe,y felt that the ordinance should be flexible to address different situations. Scalze pointed out that once the City exceeds the limits of the or•dinance, then it creates the opportunity to be imfair. Scalze stated that if the ordinance is qoinq to be amended, she felt that the higher siqn should be qranted to all properties located alonq the freeway. The Council discussed the distance r~equirement and suc~aested that the Ci ty P1 ariner r~evi ew the pr•oper•ty 1 ocated al ong the fr~eewa,y system, and make a r•ecommendation on the distance. Council sugnested that the matter be tabled for one month in order to qive the Planner the opportunity to review and report on this matter. P1r. Blesener introduced the followin~ resolution and moved its adoption: RESOLUTION N0. 89-4-155 - INSTRUCTING THE CITY PLFlNNFR TO MAKE A RECOMMFNDATION OPI A RFASONA[3LF DISTANCE ALONG BUSY THOROUGFIFARFS ~+IITHIN THE CITY SUCH AS HIGHWAY 36, 35-E, APJD 694 WITHIN WHICH THE CITY ldOULD ALLOW SIGN HFTGHTS OF 30 FEET FOR BUSINESSFS The foreqoinq resolution was duly seconded by Mr. Fahey. Apes (.51 Blesener, Fahey, Scalze, Collova, LaValle. Nays (O). Resolution declar•ed adopted. The Council suggested that the City Planner discuss this issue with the Planning Commission seeking their recommendation as well. Paqe -22-
