MINUTES <br />City Council <br />May 3, 1989 <br />SIX MONTHS PROBATIONARY PERIOD, WITH THE <br />SALARY TO BE REVIEWED AT THAT TIME, CONTINGENT <br />UPON MR. HARRIS'S LOCATING CLOSER TO THE CITY <br />WITHIN A REASONABLE AMOUNT OF TIME AND CONDITIONED <br />ON MR. HARRIS PASSING A PHYSICAL EXAM TO BE <br />PERFORMED BY DR. ALLEN OF LITTLE CANADA AND <br />CONTINGENT UPON THE CITY CLERK CHECKING THE <br />REFERENCES PROVIDED BY MR. HARRIS AND DETERMINING <br />THAT THEY ARE SATISFACTORY <br />The foregoing resolution was duly seconded by Mr. Fahey. <br />Ayes (5) Fahey, Blesener, Scalze, LaValle, Collova. <br />Nays (0). <br />Resolution declared adopted. <br />Fahey instructed the City Clerk to contact Mr. Harris as soon <br />as possible and make the job offer. Fahey reported that he would <br />draft a letter to be sent to the other applicants thanking them <br />for their interest. <br />Dan Fahey reported that the next item on the agenda is a hearing <br />Drake requested by Dan Drake relating to a two-day disciplinary <br />Hearing suspension issued to Mr. Drake by former Public Works Superin- <br />tendent Roger Glanzer. <br />The City Attorney reported that Mr. Drake has requested this <br />hearing before the Council pursuant to Section 209.200 of the <br />Personnel Ordinance relating to disciplinary action. The City <br />Attorney also reported that under the Open Meeting Law, as <br />he has previously reported to the City Council and to Mr. Drake <br />in a letter dated March 23, 1989, the actual hearing will be <br />closed since during that hearing there will be personnei matters <br />discussed that are protected under the MN Data Privacy Act. <br />The City Attorney stated that the hearing will be informal, <br />however, those giving testimoney will be under oath. There <br />will be a visual transcript of the testimony in the City Clerk's <br />file as private data, and the minutes of the open meeting portion <br />will be available to the general public. The City Clerk reported <br />that there will be a separate tape of the closed hearing that <br />will not be available to anyone except by Court order. <br />The City Attorney reported that since Mr. Drake is not <br />represented by counsel, the Mayor will handle the hearing for <br />the City, and the City Attorney would not actively participate <br />in the hearing process. <br />The City Attorney reported that the specific issue before the <br />Council is the recommendation of Roger Glanzer as contained in <br />his memo dated March 7, 1989 to Dan Drake relative to disciplinary <br />Page -3- <br />
