MINUT~S <br />Council Meeting <br />JUly 26, 19II9 <br />Valento <br />Variance <br />(cont J <br />Hoffman <br />CUP <br />t9rs.Scalze introduced the following resolution and moved <br />its adoption: <br />RESOLUTION N0. 89-7-336 - DENYING THE VALENTO FRONT SETBACK <br />VARIANCE BASED UPON TAE PLANNING COD4MISSION'S CANNOT <br />RECOP4MENDATION~ AND ALSO THAT TFIE F~PPLICANT Ig~{~~ CREATE A <br />LOT THAT WOULD HAVE NEEDED A VARIANCE 4VHICH IS AGAINST THE <br />CODE AND ALSO THAT THE CITY HF1S USED WHATEVER THEY CODLD <br />TO SFITISFY THE STRE~T IIVCLUAING THE US~ OF TAX TNCREMENT <br />FINANCING AND A DIMINISHED 40 FOOT ROAD AND BASED UPON THE <br />PROSLEM THAT FIE WOULD BE SETTING A PRECEDENT FOR OTHER LOTS <br />AND THE LOTS 4VERE CREIITED OF A SUFFICIENT SIZE WITA NO <br />GENUINE HARDSHIP SUCH A:i TOPOGRAPFIICAL, ETC. AND OTHER <br />CIRCUP4STANCES WHICH ARE DENT~D. <br />Resolution declared adopted. <br />The foregoing resolution was duly seconded by A1r. Blesener. <br />Ayes (3) Blesener, Scalze and Fahey <br />Nays (1) Collova <br />P9r. Collova stated his reason for voting against the <br />resolution was because the developers did not know what the <br />curb would do to the first four lots and the houses ~oould <br />have to be down-sized to fit the lots. He believes there <br />is a hardship. <br />Mr. IIlesener would be receptive to a 25 foot setback <br />variance to lots 2 and 3. <br />Mr. Fahey opened the Public Hearing regarding a request <br />from Mr. Richard Hoffman, 353 Rose Lane for a conditional <br />use permit for adding an addition to an existing garage. <br />The Planning Commission and the Planner recommended <br />approval of this request subject to the condition that <br />there would not be any business activity and that the <br />addition would be compatible ~oith the house. <br />P4r. Hoffman was not in attendance. Mrs. Scalze v~anted to <br />include that it could not be used for residential use. <br />Mr, Fahey introcluced the following resolution and moved its <br />adoption. <br />RESOLUTION N0. 89-7-33II - CLOSING THS PUBLIC HEARING ON THF•. <br />HOFFMAN CONDITIONAL USE PERP4TT, <br />Resolution declared adopted, <br />6 <br />The foregoing resolution was duly seconded by Mr, Collova. <br />Ayes (4) <br />Nays (0) <br />
