Fahey introduced the following resolution and moved its <br />adoptions <br />RESOLUTION NO. 89-II-363 - CAI,LING 11 PUBLIC HEARING FOR <br />6VEDNESDAY, SFPTBMBFR 27, 198~ AT 7:30 P.49, TO CONSIDER TIIE <br />RECONSTRUCTION OF PAYNE AVENUE <br />The foregoing resolution was duly seconded by 44rs. Scalze. <br />Ayes (9) Fahey, Scalze, Collova, Slesener. <br />Nays (0). <br />Resolution declared adoptede <br />The City ~ngineer submitted a report dated August 9, 1~89 <br />regarding Improvement No. II9-14, Thunder I3ay Area drainage. <br />The City Engineer reported that he has revie~•aed the area and <br />felt that the qrades of the swale are proper and the swale <br />will drain, however, residents in the area should keep the <br />swale cut and mowed, and the trees should be cleaned out of <br />the ditch. The City Engineer pointed out that the City can <br />notify the builders or property owners in the area to clean <br />out the s~aale, and if it is not done the City can do the <br />work and assess the appropriate parties. <br />Fahey pointed out that the City cannot a11ow the swale to be <br />filled in, thus blocking drainage, The ditch must be op~n <br />and flowing, <br />Mrs. Daubenspeck, 2990 Thunder Bay Road, stated that she has <br />held o£f on improving her backyard until the City addressed <br />the issue of the ditch. <br />The City Engineer pointed out that the ditch in the rear of <br />the Daubenspeck home is blockecl, and needs to be lowered by <br />about one foot. The Engineer reported that the problem that <br />is occurring in the area is that residents are filling to <br />their back lot lines rather than to the easement line. <br />Page 7 <br />
