MINUTES <br />CITY COUNCIL <br />October 25, 1989 <br />Fahey pointed out that the prime consideration of the <br />Council is whether or not a hardship exists, and not <br />the viewpoint of the neighbors. However, in this case <br />there is no hardship and the neiqhbors are opposed. <br />Fahey indicated that in this instance even if the <br />neighbors were in favor, he could not support the <br />variance. <br />Upon motion by Scalze, seconded by Blesener, the public <br />hearing was closed. <br />Mrs. Scalze introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 89-10-518 - DENYING TxE ELY ARCILLA <br />REQUEST FOR REAR YARD SETBACK VARIANCE AT 641 KELLER <br />PARKWAY DUE TO THE FACT THAT THE PROPERTY IS LARGER <br />THAN MINIMUM LOT SIZE AND THERE IS SUFFICIENT AREA ON <br />THE LOT TO BUILD A HOUSE THAT MEETS SETBACK <br />REQUIREMENTS AND SINCE IT IS THE VIEW OF THE COUNCIL <br />TAAT NO HARDSHIP EXISTS IN THE USE OF THE LOT <br />The foregoing resolution was duly seconded by Mr. <br />LaValle. <br />Ayes (5) Scalze, LaValle, Collova, Fahey, Blesener. <br />Nays (0). <br />Resolution declared adopted. <br />PUBLIC Fahey opened the Public Hearing to consider amending <br />HEARING the Conditional Use Permit for Bank Shot Billiards, <br />BANKSHOT 2660 Rice Street, to increase the number of video games <br />BILLIARDS allowed to ten. <br />Fahey pointed out that the Planning Commission <br />recommended approval of the amendment. <br />There was no one present from the general public <br />wishing to comment. <br />Upon motion by Blesener, seconded by LaValle, the <br />public hearing was closed. <br />Mr. Fahey introduced the following resolution and moved <br />its adoption: <br />RESOLUTION NO. 89-10-519 - APPROVING THE AMENDMENT TO <br />CONDITIONAL USE PERMIT FOR BANK SHOT BILLIARDS, 2660 <br />RICE STREET, TO INCREASE THE NUMBER OF VIDEO GAMES <br />ALLOWED ON TxE PREMISES TO TEN <br />Page 10 <br />
