MINUTES <br />CITY COUNCIL <br />October 25, 1989 <br />Arcilla reported that the Planninq Commission <br />recommended denial of the variance because the adjacent <br />property owners objected, especially Mr. Graf. Arcilla <br />stated that Graf objected because he felt the home <br />would be too close to his property and the house was <br />too big. Arcilla presented a diagram showing the <br />location of his proposed home in relation to the Graf <br />home. Arcilla pointed out that the nearest point of <br />his home would be 79 feet from the Graf home. <br />Therefore, Arcilla did not believe the neighbors were <br />physically effected by the variance. <br />Arcilla reviewed the City Planner's report wherein the <br />Planner recommended approval of the variance since he <br />felt the request meets the criteria as outlined in the <br />Ordinance. <br />Fahey stated that he had concern with the City <br />Planner's report which indicates that special <br />conditions are met. Fahey stated that he felt the <br />house was overdesigned, and pointed out the minimum lot <br />size is 10,000 square feet, and this lot is 15,000 <br />square feet. <br />Fahey stated that he was not concerned about the <br />distances from the Arcilla house to the Graf house, and <br />pointed out that if it were two side yards involved, <br />the minimum setback between the two homes could be 20 <br />feet. Fahey stated that there is enough buildable area <br />within the lot to lay out a house. The problem is that <br />the house Mr. Arcilla designed does not fit the lot. <br />Arcilla reported that he currently has a six-bedroom <br />home and wants a step-up from what he currently has. <br />The difficulty with the site is the shape of the lot <br />and the fact that a basement cannot be put in. <br />Blesener stated that it is obvious to him that the <br />house does not fit the lot, and that is not the City's <br />responsibility. The City must make sure that building <br />codes are being followed, and where they cannot, a <br />hardship must exist. Blesener stated that he could not <br />support the variance request. <br />Fahey encouraged Mr. Arcilla to change the design of <br />his home to fit the lot. <br />Blesener felt that if a variance were approved in this <br />instance a precedent would be set. <br />Page 9 <br />
