MINUTES <br />CITY COUNCIL <br />October 25, 1989 <br />PUBLIC Fahey opened the Public Hearing to consider the <br />HEARING application submitted by Ely Arcilla for a rear yard <br />ARCILLA setback variance at 641 Keller Parkway. <br />SETBACK <br />VARIANCE Fahey pointed out that the Planning Commission <br />recommended denial of the variance request due to the <br />objections raised by the neighbors and because the <br />Commission felt that the house proposed by Mr. Arcilla <br />was too large for the lot. Fahey reported that the <br />Council has been faced with other variance requests in <br />the past where a property owner has wanted to build a <br />house which is too large for the lot. Fahey stated <br />that this does not constitute a hardship. <br />Mr. Ely Arcilla appeared before the Council and <br />reviewed his variance request pointing out that he is <br />seeking a 14 foot variance since the closest point of <br />the back of his house would be 16 feet from the rear <br />property line. Arcilla reported that the proposed deck <br />encroaches further, however, decks are allowed up to 5 <br />feet from a property line. Arcilla presented an <br />overhead showing the lay-out of the house and also <br />presented a scale model of the home. <br />Fahey asked if an architect designed the house. <br />Arcilla replied that he designed the home and was a <br />mechanical engineer with some architectural background. <br />Arcilla pointed out that the home will be 1 1/2 stories <br />in height with no basement due to the soil conditions <br />of the property. The house had to be designed to <br />accommodate utilities and storage areas on the main <br />floor since there could be no basement. Arcilla <br />reported that his family spent many hours designing a <br />house that would fit their needs. Arcilla also pointed <br />out that the shape of the lot is unique, and difficult <br />to work with, and this is the reason that a variance is <br />necessary. <br />Fahey asked the square footage of the proposed home. <br />Arcilla replied that the house is 3,000 square feet in <br />size. Arcilla presented additional overheads showing <br />the shape of the lot as well as the shape of the lot at <br />647 Keller Parkway. Arcilla pointed out that the shape <br />of these two lots limits the buildability of the <br />property. Arcilla reported that his lot is 15,000 <br />square feet in size. <br />Page 8 <br />
