MINUTES CITY COUNCIL NOVEMBER 22, 1989 property by the Economic Development Authority as a site for a new fire station. The Attorney stated that he believes it will be necessary for the EDA to hold a special meeting to authorize the acquisition or condemnation of the property needed for the new fire department. Blesener although the EDA has been created, but there are documents that need to be drafted before the City can utilize it. Fahey stated that the powers and duties of the EDA need to be established. Blesener asked if the property could be purchased by the City and the EDA used to issue the bonding. The Attorney replied that that can be done, but the City would need to convey the property to the EDA. Fahey suggested that he qet together with the new City Administrator on this issue. The Attorney stated that he will discuss the issue with Briggs and Morgan as well. The Attorney also pointed out that a survey of the property is needed. The City Engineer reported that he has prepared topographical information on the site, and the Planner stated that he believed a boundary survey has been prepared. SPACE NEEDS The City Attorney reported that he has reviewed the ANALYSIS Owner and Architect Agreement between the City and Boarman & Associates for space needs analysis of the City Center and Fire Station and the agreement appears to be in order. However, the Attorney pointed out that under the agreement, plans would remain the property of the architect and could only be used for this project. Mr. Fahey introduced the following resolution and moved its adoption: RESOLUTION NO. 89-11-574 - APPROVING THE OWNER AND ARCAITECT AGREEMENT BETWEEN THE CITY AND BOAFtMAN AND ASSOCIATES FOR SPACE NEEDS ANALYSIS OF THE CITY CENTER AND FIRE STATION AND AUTHORIZING THE MAYOR TO SIGN THE AGREEMENT ON BEHALF OF THE CITY Page 24
