MINUTES <br />CITY COUNCIL <br />December 27, 1989 <br />PLAN REVIEW Fahey opened the public hearing to consider plan review <br />LEB for a 31,000 square foot office/showroom building at <br />DEVELOPMENT Country Drive and Nadeau Road. <br />Scalze reported that the Park Commission met on this <br />development proposal, and it was their recommendation <br />that the park charge be in cash rather than land. <br />However, the developer has a different proposal. <br />Loren Brueggemann, LEB Development, reported that the <br />Ordinance requires payment of a park charge in the <br />amount of 5% of the value of the land. Brueggemann <br />requested that the 5% be based on the $1.35 per square <br />foot land costs, rather than the purchase price of the <br />land. <br />Scalze pointed out that the Ordinance says the fair <br />market value of the property, or the purchase price as <br />contained in a purchase agreement. <br />There was no one from the general public present <br />wishing to comment on this plan review. <br />Upon motion by Fahey, seconded by Collova, the public <br />hearing was closed. <br />Fahey felt the City should be consistent with the way <br />park charges are assessed treating all developers <br />equally. <br />Scalze pointed out that the park charge would be based <br />on raw land values and would not consider the value of <br />any homes that may be on the property. Scalze pointed <br />out that the strawberry fields are raw land, and that <br />purchase price could be used as the basis for the park <br />charge for the properties. <br />Mr. Fahey introduced the following resolution and moved <br />its adoption: <br />RESOLUTION NO. 89-12-618 - APPROVING THE PUD <br />SUBDIVISION, FINAL STAGE PUD AND MULTI-PHASE COMMERCIAL <br />PARK AS WELL AS THE PLANS FOR THE FIRST PHASE, 31,000 <br />SQUARE FOOT OFFICE/SHOWROOM BUILDING AS PRESENTED, WITH <br />THE PARK CHARGE TO BE PRORATED AS BUILDING PERMITS ARE <br />ISSUED WITH THE AMOUNT OF TxE PARK CHARGE TO BE BASED <br />ON THE RECOMMENDATION OF THE PARK COMMISSION AND <br />ORDINANCE REQUIREMENTS, AND SUBJECT TO THE <br />RECOMMENDATIONS OF THE CITY PLANNER AS CONTAINED IN HIS <br />REPORT DATED DECEMBER 11, 1989 <br />Page 13 <br />
