MINUTES CITY COUNCIL December 27, 1989 PLAN REVIEW Fahey opened the public hearing to consider plan review LEB for a 31,000 square foot office/showroom building at DEVELOPMENT Country Drive and Nadeau Road. Scalze reported that the Park Commission met on this development proposal, and it was their recommendation that the park charge be in cash rather than land. However, the developer has a different proposal. Loren Brueggemann, LEB Development, reported that the Ordinance requires payment of a park charge in the amount of 5% of the value of the land. Brueggemann requested that the 5% be based on the $1.35 per square foot land costs, rather than the purchase price of the land. Scalze pointed out that the Ordinance says the fair market value of the property, or the purchase price as contained in a purchase agreement. There was no one from the general public present wishing to comment on this plan review. Upon motion by Fahey, seconded by Collova, the public hearing was closed. Fahey felt the City should be consistent with the way park charges are assessed treating all developers equally. Scalze pointed out that the park charge would be based on raw land values and would not consider the value of any homes that may be on the property. Scalze pointed out that the strawberry fields are raw land, and that purchase price could be used as the basis for the park charge for the properties. Mr. Fahey introduced the following resolution and moved its adoption: RESOLUTION NO. 89-12-618 - APPROVING THE PUD SUBDIVISION, FINAL STAGE PUD AND MULTI-PHASE COMMERCIAL PARK AS WELL AS THE PLANS FOR THE FIRST PHASE, 31,000 SQUARE FOOT OFFICE/SHOWROOM BUILDING AS PRESENTED, WITH THE PARK CHARGE TO BE PRORATED AS BUILDING PERMITS ARE ISSUED WITH THE AMOUNT OF TxE PARK CHARGE TO BE BASED ON THE RECOMMENDATION OF THE PARK COMMISSION AND ORDINANCE REQUIREMENTS, AND SUBJECT TO THE RECOMMENDATIONS OF THE CITY PLANNER AS CONTAINED IN HIS REPORT DATED DECEMBER 11, 1989 Page 13
