MINUTES <br />CITY COUNCIL <br />December 27, 1989 <br />The City Engineer agreed that chances are repairs would <br />be made by tunneling. <br />There was no one from the general public present <br />wishing to comment on this matter. <br />Upon motion by Blesener, seconded by LaValle, the <br />public hearing was closed. <br />Mr. Blesener introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 89-12-620 - APPROVING THE CONDITIONAL <br />USE PERMIT AS REQUESTED BY BURNAAM PAILBROOK FOR USE OF <br />375 EAST LITTLE CANADA ROAD AS NON-RETAIL/COMMERCIAL <br />OFFICE SPACE AS WELL AS APPROVING A CONDITIONAL USE <br />PERMIT FOR OFF-SITE PARKING FOR 20 VEHICLES, AND <br />GRANTING CONCEPT APPROVAL FOR UP TO 10,000 SQUARE FEET <br />OF BUILDING ADDITION PLUS ADDITIONAL PARKING SUBJECT TO <br />TAE RECOMMENDATIONS OF THE CITY PLANNER AS CONTAINED IN <br />HIS REPORT DATED DECEMBER 11, 1989 WITH THE STIPULATION <br />THAT IF A BUILDING ADDITION IS CONSTRUCTED ON THE <br />CITY'S SEWER EASEMENT, THE PROPERTY OWNER WOULD BE <br />RESPONSIBLE FOR ANY COSTS INVOLVED IN THE REPAIRS THAT <br />ARE A RESULT OF THE BUILDING LOCATION <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Blesener, LaValle, Fahey, Scalze, Collova. <br />Nays (0). <br />Resolution declared adopted. <br />AMENDMENT TO Fahey opened the public hearing to consider amending <br />COMPREHENSIVE the Comprehensive Plan to re£lect rezoning of 73, 77, <br />PLAN 83 and 89 West County Road C. <br />The City Planner pointed out that he requested that the <br />Planning Commission table action on this matter to give <br />him an opportunity to provide them with additional <br />information. <br />Fahey suggested that the Council hold the public <br />hearing on this matter, but table action pending <br />receipt of the Planning Commission's recommendation. <br />Bill Souchy, County Road C resident, requested that his <br />entire lot be rezoned to R-l. Souchy was concerned <br />that if there was a fire in his home, he would not be <br />allowed to rebuild since his home is non-conforming. <br />Fahey suggested that if there was a fire at the Souchy <br />home, that Souchy request a rezoning at that time. <br />Page 17 <br />
