MINUTES <br />CITY COUNCIL <br />December 27, 1989 <br />Fahey pointed out that these are conditions of the <br />grant and the alternative would be for a developer to <br />put in the storm shelter and assess the cost back to <br />the property owners. Fahey pointed out that Big Circle <br />Drive is a private road and asked if the City will need <br />an easement to use this road for access to the storm <br />shelter. <br />Blesener pointed out that City ownership and <br />maintenance of the storm shelter are a change from what <br />was discussed previously. <br />Scalze pointed out that when the City invites people to <br />use the Fire Station as a storm shelter, the City <br />assumes that liability. <br />Fahey agreed that the proposal has changed, however, <br />felt the City should go forward with the project. <br />The City Attorney thought that ingress and egress to <br />the shelter had been covered. <br />The City Administrator suggested that the City consider <br />a lease provision giving some of the responsibilities <br />of the shelter back to the property owner. <br />The City Attorney stated that the present agreement <br />does not address the maintenance issue. <br />Fahey agreed that leasing maintenance back to the <br />property owner should be checked into, but did not <br />think the Council should get hung up on this issue. <br />Blesener stated that he was uneasy about the situation. <br />Mr. Fahey introduced the following resolution and moved <br />its adoption: <br />RESOLUTION N0. 89-12-625 - CONFIRMING THE CITY'S INTENT <br />TO ACQUIRE TITLE TO THE NECESSARY PROPERTY FROM TAE <br />NORTH STAR ESTATES TRAILER PARK SUFFICIENT IN AREA TO <br />ACCOMMODATE A STORM SHELTER FOR TRAILER PARK RESIDENTS <br />AND CONFIRMING THE CITY'S INTENTION TO MAINTAIN THAT <br />PROPERTY <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (4) Fahey, Collova, LaValle, Scalze. <br />Nays (1) Blesener. <br />Resolution declared adopted. <br />Page 23 <br />
