MINUTES <br />CITY COUNCIL <br />December 27, 1989 <br />Fahey pointed out that the rate of flow doesn't matter, <br />there are easements missing, and the City cannot allow <br />the run-off to continue without the necessary <br />easements. <br />Mr. Fahey introduced the following resolution and moved <br />its adoption: <br />RESOLUTION NO. 89-12-614 - INSTRUCTING THE CITY <br />ENGINEER AND CITY ATTORNEY TO WORK TOGETHER AS <br />NECESSARY TO OBTAIN THE NECESSARY UTILITY AND DRAINAGE <br />EASEMENTS WITH REGARD TO THE CENTRE PLACE PLAT <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Fahey, LaValle, Scalze, Blesener, Collova. <br />Nays (0). <br />Resolution declared adopted. <br />Boosalis reported that he needs to get the <br />single-family portion of the project going to fulfill <br />his commitments under the development agreement. <br />Boosalis also pointed out that he has someone <br />interested in building the single-family homes, and was <br />concerned that that interest would shift if the project <br />could not get underway. Boosalis also pointed out that <br />the faster the homes develop within the plat, the more <br />increment the project will generate. <br />Boosalis expressed concern about the number of ineetings <br />he has attended where concerns have been expressed that <br />he was not made aware of until the meeting. Boosalis <br />was also concerned about the desire to stop the project <br />until the easements to the north are acquired, with <br />Boosalis pointing out that that is not in the <br />development agreement. <br />Fahey asked how long it will take to obtain the <br />easements. <br />The City Attorney replied that until he gets the legal <br />descriptions, he cannot verify ownership of the <br />property. <br />The City Engineer estimated that there will only be <br />three owners involved in the easements. <br />Page 7 <br />
