MINUTES <br />City Council <br />February 28, 1990 <br />ARBITRATION The City Administrator reviewed the advantages and <br />CLAUSE IN disadvantages of including an arbitration clause in <br />CITY City construction contracts as outlined in his memo <br />dated February <br />CONTRACTS 28, 1990. <br />After review and discussion, it was the concensus of <br />the Council that it would be in the best interests of <br />the City to remove the arbitration clause from City <br />construction contracts. <br />Mr. Fahey introduced the following resolution and moved <br />its adoption: <br />RESOLUTION N0. 90-2-103 - ESTABLISHING A POLICY <br />DELETING THE ARBITRATION CLAUSE FROM CITY CONTRACTS FOR <br />IMPROVEMENTS EFFECTIVE IMMEDIATELY <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (4) Fahey, Blesener, Scalze, LaValle. <br />Nays (1) Collova. <br />Resolution declared adopted. <br />FRATTALONE The City Planner reported that Frank Frattalone could <br />RECYCLING not be present this evening and has asked that the <br />CENTER Council continue discussion of his recycling center <br />until the next Council meetinq. The Planner stated <br />that he believed the situation would be controllable, <br />and pointed out that the City already has an ordinance <br />in place which would allow a time limit to be placed on <br />the use. <br />Scalze pointed out requirement of a principle structure <br />of at least 1,000 square feet in size in order for the <br />operation to fit within the City's ordinance. <br />Fahey suggested that a workshop meeting of the Council <br />be scheduled to discuss the issues of the Frattalone <br />recyclinq center as well as landscape ordinace. <br />5calze felt the Planning Commission should comment on <br />the recycling center. <br />Fahey and Blesener agreed, pointing out that the <br />Planning Commission should determine if the land use is <br />an appropriate one. <br />Mr. Fahey introduced the following resolution and moved <br />its adoption: <br />Page 20 <br />
