MINUTES <br />CITY COUNCIL <br />April 11, 1990 <br />Scalze suggested that the Council think about this <br />issue and that the matter be placed on the May 23rd <br />agenda for consideration, including the proposed liquor <br />license ordinance. <br />CLOSED The City Attorney requested that the Council go into <br />SESSION closed session following the meeting to discuss pending <br />litigation. <br />Mr. Blesener introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 90-4-172 - CALLING FOR A CLOSED SESSION <br />IMMEDIATELY FOLLOWING TONIGHT'S MEETING AT THE REQUEST <br />OF THE CITY ATTORNEY TO DISCUSS PENDING LITIGATION <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (4) Blesener, Scalze, Collova, LaValle. <br />Nays (0). <br />Resolution declared adopted. <br />SHOULDER Council reviewed the Shoulder Paving Agreements <br />PAVING submitted by the County for improvement of shoulders <br />AGREEMENTS along Little Canada Road and County Road D. <br />Blesener stated that it was his understanding that the <br />work would be similar to a sealcoating, and he did not <br />believe that the City should assess for this type of <br />work. Blesener pointed out that sealcoating is normal <br />maintenance, and the City does not assess for the <br />sealcoating that it contracts each year. Blesener <br />reported that shoulders were improved last year along <br />Little Canada Road between County Road C and the <br />railroad tracks and the City assessed this improvement. <br />However, Blesener believed that to be a mistake. <br />Blesener reported that depending on County finances, <br />Little Canada Road may be reconstructed in the next 4 <br />to 9 years, and Blesener asked how the City will be <br />able to assess for the improvement of curb and gutter <br />if it has already assessed for shoulders. <br />The City Attorney reported that the theory behind <br />assessments is that the improvement must increase the <br />market value of the property by the amount of the <br />assessment. <br />Collova believed the shoulder improvement was more than <br />Page 13 <br />
