MINUTES CITY COUNCIL May 9, 1990 RESOLUTION NO. 90-5-234 - ALLOWING THE TEMPORARY OPERATION OF THE FRATTALONE RECYCLING OPERATION PENDING A FINAL DECISION ON THE MATTER AS A PERMITTED USE BY THE CITY COUNCIL~ LIMITING THE MATERIALS TO BE HAULED INTO TAE SITE TO THOSE FOR WHICH MR. FRATTALONE IS UNDER CONTRACT, AND REQUIRING FRATTALONE TO PROVIDE COPIES OF THOSE CONTRACTS TO THE CITY ENGINEER FOR HIS REVIEW, REQUIRING MR. FRATTALONE TO POST A BOND FOR THE CITY'S WATERMAIN AND STREETS IN AN AMOUNT TO BE DETERMINED ACCEPTABLE TO THE CITY ENGINEER, AND REQUIRING FRATTALpNE TO TAKE APPROPRIATE MEASURES TO CONTROL DUST The foregoinq resolution was duly seconded by Blesener. Ayes (2) Fahey, Scalze. Nays (3) Blesener, Collova, LaValle. Resolution denied. Blesener, Collova, and LaValle opposed the resolution due to the limitation of hauling in materials only under contract. Scalze was concerned that Mr. Frattalone would obtain additional contracts if this limitation was not in place. Blesener pointed out that when a final decision is made the City has the option of shutting the operation down right away, therefore, if Frattalone were to obtain additional contracts, it would be at his own risk. Blesener pointed out that without the limitation, if Frattalone obtains a small job he will be able to dispose of the material. Frattalone stated that he understood the operation was at risk, but pointed out that if it is not approved, he will need time to find another site to relocate the business. It was noted that the matter will come to the Council for a final decision on June 25th. Mr. LaValle introduced the following resolution and moved its adoption: RESOLUTION NO. 90-5-235 - APPROVING THE TEMPORARY OPERATION OF THE FRATTALONE RECYCLING BUSINESS UNTIL REVIEW AND FINAL DECISION BY BOTH THE PLANNING COMMISSION AND CITY COUNCIL WITH FINAL DECISION AS TO EITHER ALLOWING THE OPERATION AS A PERMITTED USE OR Page 13
