MINUTES <br />CITY COUNCIL <br />May 9, 1990 <br />RESOLUTION NO. 90-5-234 - ALLOWING THE TEMPORARY <br />OPERATION OF THE FRATTALONE RECYCLING OPERATION PENDING <br />A FINAL DECISION ON THE MATTER AS A PERMITTED USE BY <br />THE CITY COUNCIL~ LIMITING THE MATERIALS TO BE HAULED <br />INTO TAE SITE TO THOSE FOR WHICH MR. FRATTALONE IS <br />UNDER CONTRACT, AND REQUIRING FRATTALONE TO PROVIDE <br />COPIES OF THOSE CONTRACTS TO THE CITY ENGINEER FOR HIS <br />REVIEW, REQUIRING MR. FRATTALONE TO POST A BOND FOR THE <br />CITY'S WATERMAIN AND STREETS IN AN AMOUNT TO BE <br />DETERMINED ACCEPTABLE TO THE CITY ENGINEER, AND <br />REQUIRING FRATTALpNE TO TAKE APPROPRIATE MEASURES TO <br />CONTROL DUST <br />The foregoinq resolution was duly seconded by Blesener. <br />Ayes (2) Fahey, Scalze. <br />Nays (3) Blesener, Collova, LaValle. <br />Resolution denied. <br />Blesener, Collova, and LaValle opposed the resolution <br />due to the limitation of hauling in materials only <br />under contract. <br />Scalze was concerned that Mr. Frattalone would obtain <br />additional contracts if this limitation was not in <br />place. <br />Blesener pointed out that when a final decision is made <br />the City has the option of shutting the operation down <br />right away, therefore, if Frattalone were to obtain <br />additional contracts, it would be at his own risk. <br />Blesener pointed out that without the limitation, if <br />Frattalone obtains a small job he will be able to <br />dispose of the material. <br />Frattalone stated that he understood the operation was <br />at risk, but pointed out that if it is not approved, he <br />will need time to find another site to relocate the <br />business. <br />It was noted that the matter will come to the Council <br />for a final decision on June 25th. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 90-5-235 - APPROVING THE TEMPORARY <br />OPERATION OF THE FRATTALONE RECYCLING BUSINESS UNTIL <br />REVIEW AND FINAL DECISION BY BOTH THE PLANNING <br />COMMISSION AND CITY COUNCIL WITH FINAL DECISION AS TO <br />EITHER ALLOWING THE OPERATION AS A PERMITTED USE OR <br />Page 13 <br />
