MINUTES <br />CITY COUNCIL <br />May 9, 1990 <br />why he began using Ryan Drive for hauling after road <br />restrictions were taken off. Frattalone reported that <br />he has taken measures to control the dust and he was <br />willing to pave the roadway in from Country Drive to <br />ensure that dust is controlled and there is not a <br />tracking problem. However, he did not want to pave and <br />construct a fence unless he is granted a permit. <br />Frattalone also stated that it was not possible that a <br />side-thrust from the weight of the stockpiles was <br />effecting the buildings across the street since Country <br />Drive was subcut and replaced with good fill. <br />Frattalone reported that the thrust from the weight of <br />the stockpiles will take the route of least resistence <br />which is the peat material and not Country Drive. <br />Frattalone also pointed out that his recycling piles <br />are located 125 feet from the curb at the closest <br />point, which is a good distance from the watermain. <br />Frattalone agreed that driving over the watermain could <br />be a problem, and indicated that if the main breaks <br />because of this, he will repair it. Frattalone <br />reported that he has repaired the watermain breaks in <br />the area and agreed that these breaks were caused by <br />the deterioration of the bolts at the pipe joints which <br />deteriorated because of the peat. <br />Scalze noted that the matter of the continued operation <br />of the recycling operation comes before the Planning <br />Commission for review on June 14th. <br />Fahey suggested that the City survey the residents and <br />business owners in the area to determine how they feel <br />about the continued operation of the recycling center. <br />Fahey felt that if there is a dust and noise problem, <br />the center should not be allowed to continue to operate <br />in our City. Fahey pointed out that the dust has not <br />been controlled while the center is operating without a <br />permit, and questioned that it would be controlled <br />after a permit is granted. <br />Frattalone agreed that he did not control the dust for <br />a couple of days, and suggested that dust control be a <br />condition of the permit. Then, if dust is not <br />controlled, the City can shut down the operation or <br />revoke the permit if the problem persists. <br />Fahey felt the operation was like having a road <br />constantly under construction. Fahey pointed out the <br />complaints the City receives in these situations. <br />Page 8 <br />
