MINUTES <br />CITY COUNCIL <br />May 23, 1990 <br />Fahey thought that some of the concerns raised by Iona <br />Lane residents would exist if the Haram property were <br />developed with a single-family home. Fahey felt the <br />best that could be done would be to allow the existing <br />use of the property to continue, but amend the <br />ordinance making convenience stores a conditional use <br />in a B-1 area. Fahey stated that the other concerns <br />raised by the Iona Lane residents, such as the sign <br />violation and snow plowing, would be handled as a <br />matter of policy. <br />Osland questioned the need to rezone the property. <br />Mr. Haram explained that he was refinancing the <br />property due to a balloon payment that was due. The <br />loan he obtained was a commercial loan, and the bank's <br />underwriters are requiring that the property's zoning <br />be in conformance to its use. <br />Fahey pointed out that the Council could approve the <br />rezoning and then declare a moratorium on the issuance <br />of building permits for B-1 property in the City until <br />Council acts on the issue of making convenience stores <br />in a B-1 District a conditional use. <br />Scalze suggested that in order to resolve the parking <br />problem, Iona Lane be posted as no parking from the <br />corner to 40 feet to the east. <br />It was pointed out that this section of Iona Lane is <br />already posted as no parking. Haram indicated that he <br />was not aware of a parking problem on his property <br />other than Sunday mornings, and he has been working <br />with the Church to address this. Haram pointed out <br />that if his lot were not used on Sunday mornings, Iona <br />Lane residents would have cars parked in front of their <br />homes. <br />There was no one else from the general public present <br />wishing to speak on this matter. <br />Upon motion by Blesener, seconded by LaValle, the <br />public hearing was closed. <br />Mr. Blesener introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 90-5-252 - APPROVING THE REZONING OF THE <br />AARAM PROPERTY LOCATED AT 2700 RICE STREET FROM R-1 TO <br />B-1 AS RECOMMENDED BY THE CITY PLANNER AND THE PLANNING <br />COMMISSION <br />Page 6 <br />
