MINUTES <br />CITY COUNCIL <br />JULY 25, 1990 <br />Eagan pointed out that she has paid the road assessment <br />believing that she had road access. <br />Fahey pointed out that the Council can abate the <br />assessment provided that Eagan agree that should the <br />property be developed in the future, the assessment <br />will be repaid. Fahey also pointed out that the City <br />will place a restrictive covenant on the property to <br />this effect, and the property owner will have to pay <br />the costs associated with this covenant. <br />The Administrator pointed out the adjacent property <br />that is owned by the State of Minnesota. The <br />Administrator felt Mrs. Eagan's best option would be to <br />contact the State to determine if they are interested <br />in selling the property. This property is relatively <br />flat and the two parcels could possibly be combined to <br />create buildable parcels. <br />Eagan objected to assuming the cost of the restrictive <br />covenant. Eagan stated that the City has landlocked <br />her property. <br />Fahey pointed out that the matter was discussed at the <br />previous Council meeting and this action is in <br />conformity with others that have occurred. <br />Eagan questioned the amount of the assessment as <br />calculated by the City Administrator. <br />Fahey suggested that Mrs. Eagan work out this issue <br />with the City Administrator. <br />Mr. Blesener introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 90-7-350 - APPROVING THE RECOMMENDATION <br />OF THE CITY ADMINISTRATOR REGARDING THE EAGAN <br />ASSESSMENT FOR MINNESOTA AVENUE TO REBATE AND ABATE <br />ASSESSMENTS AGAINST THE PROPERTY SUBJECT TO A <br />RESTRICTIVE COVENANT BEING PLACED ON THE PROPERTY <br />DECLARING THE PROPERTY TO BE UNBUILDABLE AND SUBJECT TO <br />MRS. EAGAN PAYING THE LEGAL FEES FOR DRAFTING AND <br />FILING OF THE RESTRICTIVE COVENANT <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) Blesener, Scalze, Fahey, LaValle, Collova. <br />Nays (0). <br />Resolution declared adopted. <br />Page 22 <br />
