MINUTES CITY COUNCIL JULY 25, 1990 Eagan pointed out that she has paid the road assessment believing that she had road access. Fahey pointed out that the Council can abate the assessment provided that Eagan agree that should the property be developed in the future, the assessment will be repaid. Fahey also pointed out that the City will place a restrictive covenant on the property to this effect, and the property owner will have to pay the costs associated with this covenant. The Administrator pointed out the adjacent property that is owned by the State of Minnesota. The Administrator felt Mrs. Eagan's best option would be to contact the State to determine if they are interested in selling the property. This property is relatively flat and the two parcels could possibly be combined to create buildable parcels. Eagan objected to assuming the cost of the restrictive covenant. Eagan stated that the City has landlocked her property. Fahey pointed out that the matter was discussed at the previous Council meeting and this action is in conformity with others that have occurred. Eagan questioned the amount of the assessment as calculated by the City Administrator. Fahey suggested that Mrs. Eagan work out this issue with the City Administrator. Mr. Blesener introduced the following resolution and moved its adoption: RESOLUTION NO. 90-7-350 - APPROVING THE RECOMMENDATION OF THE CITY ADMINISTRATOR REGARDING THE EAGAN ASSESSMENT FOR MINNESOTA AVENUE TO REBATE AND ABATE ASSESSMENTS AGAINST THE PROPERTY SUBJECT TO A RESTRICTIVE COVENANT BEING PLACED ON THE PROPERTY DECLARING THE PROPERTY TO BE UNBUILDABLE AND SUBJECT TO MRS. EAGAN PAYING THE LEGAL FEES FOR DRAFTING AND FILING OF THE RESTRICTIVE COVENANT The foregoing resolution was duly seconded by Scalze. Ayes (5) Blesener, Scalze, Fahey, LaValle, Collova. Nays (0).
