MINUTES <br />CITY COUNCIL <br />AUGUST 8, 1990 <br />Fahey pointed out that the City has never accepted <br />responsibility for Ryan Drive, and pointed out that the <br />road was put in in a substandard manner. <br />Fahey pointed out that the City has the option of <br />reconstructing Ryan Drive and assessing the cost <br />against the benefiting property owners. Fahey stated <br />that it was his position that the ball-joint pipe <br />should be at the developer's expense, installed to City <br />standards, and the City could accept responsibility for <br />that portion of the pipe within road right-of-way. <br />Stanke suggested that the watermain improvement be <br />postponed until Frattalone Excavating stops <br />stockpiling. <br />Collova pointed out that Frattalone is not hauling on <br />Ryan Drive. <br />Scalze questioned how the industrial park can be served <br />by a low tonage road. <br />Stanke expressed concern that his building is 95% <br />completed, however, the Building Inspector does not <br />want him to occupy the new addition until the sprinkler <br />system is complete. <br />Collova suggested that once the sprinkler system is <br />installed in the building and watermain run out to the <br />road, he could be allowed to occupy the building. When <br />watermain goes in the road, Stanke would be required to <br />connect. <br />Fahey agreed as long as Stanke enters into a <br />development agreement with the City agreeing to the <br />improvement at his expense. <br />Blesener pointed out that it may be five to six months <br />before the watermain is put in the street. <br />Stanke stated that he was ready tomorrow to begin <br />installation on his property. Stanke indicated, <br />however, that he does not want the responsibility for <br />maintenance of the watermain necessary within the road <br />right-of-way. <br />Blesener suggested that Stanke be required to pay for <br />the improvement, and if done to City standards, the <br />City accept the responsibility for maintenance of the <br />main within the right-of-way. <br />Page 13 <br />
