MINUTES
CITY COUNCIL
AUGUST 8, 1990
Fahey announces that he will not be a candidate for
Mayor in this election, and thanked the citizens of
Little Canada for the honor of serving as their Mayor
for the past three terms.
Fahey further reported that the City is in need of
additional election judges in the IR Party to achieve
party parity. Anyone interested should contact the
City Administrator.
FLEISCHHACKER Fahey opened the public hearing to consider the
STREET petition for vacation of that portion of Second Street
VACATION lying between the easterly right-of-way of Rice Street
and westerly right-of-way of Middle Street, between
Blocks Eleven and Fourteen, Rice Street Motor Line
Addition.
Mr. Steve Bruns, attorney representing Mr. Ardwin
Fleischhacker, one of the petitioners, appeared before
the Council and reported that Mr. Fleischhacker is
selling the property and the alleyway and street
easements appear as clouds on the title. Bruns pointed
out that there is a building constructed over the
alleyway easement on the property.
The City Administrator reported that staff has reviewed
the vacation request and has determined that there
would be no negative impact to the City if it were
approved. There is an existing storm sewer easement on
the property, however, the vacation would not effect
that easement. The Administrator pointed out that the
property adjoining Second Street is owned by the St.
Paul Water Department, and they are co-signers on the
petition.
The City Attorney stated that he could see no problem
with granting the vacation.
Fahey asked if there was anyone from the general public
present wishing to comment on this matter. There was
not.
Upon motion by Scalze, seconded by LaValle, the public
hearing was closed.
Page 2
