MINUTES CITY COUNCIL AUGUST 8, 1990 It was suggested that the watermain easement go to the west of the oak tree rather than the east. The City Engineer replied that this may have a greater impact on the western property, than running the watermain on the eastern side of the tree. However, this will be looked at. Mr. Heinel asked if DeSoto were improved, if the industrial park would be required to pay a portion of the cost of the street improvement. Fahey pointed out that the industrial park could not be assessed for the street if the businesses were not allowed to use it. Fahey felt that Mr. Heinel's earlier statement was correct that the residential property on the east side of DeSoto will have to develop differently. There was no one else wishing to comment on this matter. Upon motion by Blesener, seconded by LaValle, the public hearing was closed. Mr. Blesener introduced the following resolution and moved its adoption: RESOLUTION NO. 90-8-367 - ORDERING IMPROVEMENT NO. 90-10, IMPROVEMENT OF DESOTO AVENUE LYING NORTH OF ALLEN AVENUE AND EXTENDING TO THE SOUTHEAST CORNER OF THE SLUMBERLAND PROPERTY BY INSTALLATION OF WATERMAIN AND APPURTENANCES AND AUTHORIZING THE CITY ENGINEER TO PREPARE PLANS AND SPECIFICATIONS FOR SUCH IMPROVEMENT CONTINGENT ON SLUMBERLAND'S AGREEMENT TO PAY THE TOTAL COST OF SAID IMPROVEMENT WITH THE STIPULATION THAT IF TAE LOWER THREE LOTS ALONG THE EAST SIDE OF DESOTO WANT TO CONNECT TO THE WATERMAIN IMPROVEMENT THAT THEY REIMBURSE SLUMBERLAND FOR THEIR FAIR SHARE OF THE IMPROVEMENT COSTS, AND WITH THE CONDITION THAT THE ATTEMPTS BE MADE TO LOCATE THE WATERMAIN ON THE EAST OR WEST SIDE OF THE EXISTING OAK TREE LYING WITHIN THE ROAD RIGHT-OF-WAY The foregoing resolution was duly seconded by Fahey.
