MINUTES <br />CITY COUNCIL <br />AUGUST 22, 1990 <br />checked with the State Historical Society as well as <br />County Aistorical Society, and the oak tree within the <br />DeSoto right-of-way has no registered historical <br />significance. However, efforts will be made to <br />preserve the tree. The right-of-way is being surveyed, <br />and it will be determined how the tree lies in relation <br />to the right-of-way. <br />The City Administrator reported that Slumberland will <br />construct the watermain project according to the <br />specifications determined by the City Engineer. <br />Slumberland will bear the entire cost of the project, <br />and the City will be reviewing the contractor to <br />determine that he is acceptable. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 90-8-391 - APPROVING THE SLUMBERLAND <br />DEVELOPMENT AGREEMENT AND AUTHORIZING THE MAYOR AND <br />CITY ADMINISTRATOR TO EXECUTE THE AGREEMENT ON BEHALF <br />OF THE CITY <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (5) LaValle, Blesener, Fahey, Collova, Scalze. <br />Nays (0). <br />Resolution declared adopted. <br />The City Administrator reported that Slumberland's <br />agreement to bear the full cost of the project <br />eliminates the assessment proceedings. If property <br />owners wish to connect to the watermain improvement, <br />they would face a connection charge equal to benefit. <br />No arrangements exist in this agreement for Slumberland <br />to be reimbursed this portion of their project costs. <br />INVENTORY OF Council reviewed the listing of City-owned properties <br />CITY-OWNED and asked the status of the title for the Twin Lake <br />PROPERTIES Road property. <br />The City Attorney replied that he is still trying to <br />acquire the title from the Examiner of Titles' office. <br />The Attorney reported that he would follow up with the <br />County and report back to the Council. <br />Council felt it appeared that the Twin Lake Road <br />property was the only site that oould be disposed of <br />once the title was cleared. <br />Fahey suggested that the various organizations in the <br />Page 17 <br />
