MINUTES <br />CITY COUNCIL <br />AUGUST 22, 1990 <br />RESOLUTION NO. 90-5-386 - VACATING THE SNOWFENCE <br />EASEMENT ON THE PROPERTY LOCATED AT 2923 LABORE ROAD AS <br />A HOUSEKEEPING MATTER SINCE THERE IS NO APPARENT NEED <br />TO RETAIN THE EASEMENT <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (4) Scalze, Blesener, Collova, LaValle. <br />Nays (0). <br />Abstains (1) Fahey. <br />Resolution declared adopted. <br />PRELIMINARY Fahey opened the Public Hearing to consider the <br />PLAT - COSTA preliminary plat of the Costa Estates. Fahey pointed <br />ESTATES out that the Planning Commission has recommended that <br />the plat be approved provided that Noel Drive is <br />extended through to Allen Avenue on the north and <br />LaBore Road on the south. If that cannot occur, the <br />Planning Commission wants any alternatives presented to <br />them for review. <br />Bob DeBace, representing the Costa family, appeared <br />before the Council to present the plat. DeBace began <br />with an explanation of the Noel Drive right-of-way <br />situation, pointing out that the Costa family will <br />dedicate the necessary 50-foot right-of-way for Noel <br />Drive through their property. There is 30 feet of <br />right-of-way available to the City for that portion of <br />Noel Drive extending from the northern boundary of the <br />Costa property to Allen Avenue. DeBace reported that <br />there are three properties that would need to dedicate <br />the additional 20 feet, these being the Bruhn, Wright <br />and Plessel properties. <br />Mr. Clarence Bruhn indicated that he would sell his <br />entire back lot. The purchaser could then dedicate the <br />additional right-of-way that is needed. <br />DeBace reported that Mr. Wright, at 2985 Vanderbie, is <br />willing to dedicate his 20 feet of right-of-way for <br />Noel Drive. <br />With regard to the Plessel property, DeBace reported <br />that in 1977 Mrs. Johnson, who then owned the property, <br />requested a lot split. The Council approved that split <br />provided that 30 feet of right-of-way be dedicated for <br />proposed Noel Drive. However, the easement was never <br />filed. <br />The City Administrator reported that this matter was <br />also discussed by the Council in 1987 as part of Mr. <br />Page 4 <br />
