MINUTES CITY COUNCIL AUGUST 22, 1990 DeBace reported that the City Engineer has determined that the existing storm sewer is adequate to serve the area, however, additional catch basins are needed. Fahey pointed out that the engineering details would have to be worked out, but do not appear to be insurmountable. Hartman stated that he did not object to the additional homes in the area, however, did not want his road changed, and did not like to see the additional traffic that the development will generate. Mr. Peterson submitted to the Council a petition from the property owners on the south objecting to the extension of Noel Drive through to LaBore Road. Milan Moravetz, 476 Allen Avenue, stated that while he did not object to the extension of Noel Drive through to Allen, he wanted to know if he would be assessed. Fahey stated that the Moravetz property would not be benefited by the road, and City policy has been when there is already road frontage, there would be no additional assessment. The City Administrator stated that there has been some discussion by the Council in the past about assessing 20% of the distance on a corner lot. Collova thought that policy applied to road reconstruction. Fahey suggested that the City Administrator research the City records on this matter. Moravetz stated that while he would not object to any assessment for improvements made on Al1en, he did object to an assessment for Noel Drive. Moravetz also pointed out that he has a water stub out to Allen Avenue, and would be opposed to having to connect to watermain from Noel Drive. Moravetz also stated that should Noel Drive be improved from Al1en to LaBore Road, he felt there should be some cross streets and a walkway easement for access to the park. Peterson asked if there was a certain number of feet that a house must be from a property line. Blesener reported that the required setback for a rear yard is 30 feet.
