MINUTES <br />CITY COUNCIL <br />SEPTEMBER 12, 1990 <br />were contributing to the problem. These percentages <br />were agreed to by all the property owners involved. <br />Scalze suggested that if further improvements are <br />necessary, the same percentages may be applicable. <br />Fahey agreed that City staff needs to take a look at <br />the situation, as well as review past actions, and <br />should then come back with a recommendation to the City <br />Council. <br />Norris also suggested that the pond may be silting up <br />and should be dredged. <br />Lovell again raised the easement question. <br />The City Attorney suggested that if the City determined <br />that it did not want to maintain the run-way area, it <br />would not have gotten a maintenance easement for this <br />area. However, the City did obtain permanent easements <br />for the pond. <br />Fahey again asked for a staff recommendation as well as <br />research into the easement question. The City <br />Administrator was instructed to coordinate the research <br />with the City Engineer, City Attorney, and former City <br />Engineer. <br />It was the ooncensus of the Council not to require a <br />developer deposit to cover consultant costs at this <br />time. Council also requested that the matter be placed <br />on the September 26th Council meeting agenda. <br />Mr. Fahey introduced the following resolution and moved <br />its adoption: <br />RESOLUTION NO. 90-9-420 - AUTHORIZING CITY STAFF TO <br />PREPARE THE APPROPRIATE INVESTIGATION AND <br />RECOMMENDATION TO THE COUNCIL IN THE MATTER OF THE <br />SLEEPY HOLLOW DRAINAGE ISSUE, AND IF INITIAL EVALUATION <br />OF THE SLEEPY HOLLOW POND SHOWS THAT CORRECTIVE ACTION <br />IS NEEDED IN THE INTERIM THAT STAFF PROCEED TO TAKE TAE <br />APPROPRIATE ACTION SUBJECT TO VERIFICATION BY THE CITY <br />ATTORNEY THAT THE CITY HAS AN EASEMENT OVER THE POND <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) Fahey, Scalze, Collova, LaValle, Blesener. <br />Nays (o). <br />Resolution declared adopted. <br />RECESS At this point in the meeting, 9:00 P.M., Council took a <br />short recess.
