MINUTES CITY COUNCIL SEPTEMBER 12, 1990 were contributing to the problem. These percentages were agreed to by all the property owners involved. Scalze suggested that if further improvements are necessary, the same percentages may be applicable. Fahey agreed that City staff needs to take a look at the situation, as well as review past actions, and should then come back with a recommendation to the City Council. Norris also suggested that the pond may be silting up and should be dredged. Lovell again raised the easement question. The City Attorney suggested that if the City determined that it did not want to maintain the run-way area, it would not have gotten a maintenance easement for this area. However, the City did obtain permanent easements for the pond. Fahey again asked for a staff recommendation as well as research into the easement question. The City Administrator was instructed to coordinate the research with the City Engineer, City Attorney, and former City Engineer. It was the ooncensus of the Council not to require a developer deposit to cover consultant costs at this time. Council also requested that the matter be placed on the September 26th Council meeting agenda. Mr. Fahey introduced the following resolution and moved its adoption: RESOLUTION NO. 90-9-420 - AUTHORIZING CITY STAFF TO PREPARE THE APPROPRIATE INVESTIGATION AND RECOMMENDATION TO THE COUNCIL IN THE MATTER OF THE SLEEPY HOLLOW DRAINAGE ISSUE, AND IF INITIAL EVALUATION OF THE SLEEPY HOLLOW POND SHOWS THAT CORRECTIVE ACTION IS NEEDED IN THE INTERIM THAT STAFF PROCEED TO TAKE TAE APPROPRIATE ACTION SUBJECT TO VERIFICATION BY THE CITY ATTORNEY THAT THE CITY HAS AN EASEMENT OVER THE POND The foregoing resolution was duly seconded by Scalze. Ayes (5) Fahey, Scalze, Collova, LaValle, Blesener. Nays (o). Resolution declared adopted. RECESS At this point in the meeting, 9:00 P.M., Council took a short recess.
