MINUTES <br />CITY COUNCIL <br />SEPTEMBER 12, 1990 <br />PARK Council reviewed the applications received from Nanoy <br />COMMISSION Zoch, William Cremeen, and Karen Johnson for the <br />VACANCY vacancy on the Park Commission which was recently <br />advertised. Council took a ballot which resulted in <br />Blesener, LaValle, and Scalze voting for Zoch and <br />Collova and Fahey voting for Cremeen. Therefore, Zoch <br />was appointed to a term on the Park Commission running <br />through December 31, 1993. Council thanked all those <br />applying for their interest. <br />CALL FOR The City Administrator reported that the developers of <br />PUBLIC Kandice Heights are requesting the vacation of a <br />AEARING portion of the City's utility easement within vacated <br />VACATION Country Drive, as well as five feet of the road right- <br />KANDICE HGTS. of-way for Nadeau Road. The Administrator reported <br />that the City Engineer has reviewed the request and <br />feels the vacation of the utility easement portion is <br />feasible since the City's utilities are located outside <br />the area requested to be vacated. <br />The Administrator reported that with regard to the road <br />right-of-way easement, the City currently has 30 feet <br />of road riqht-of-way. The standard is 50 feet. 16 1/2 <br />feet additional feet are beinq dedicated as part of the <br />Kandice Heights Phase I project, therefore, the City is <br />still in need of 3 1/2 feet of road right-of-way. The <br />Kandice Heights developers are requesting that the City <br />vacate 5 feet of the northern portion of Nadeau Road <br />right-of-way, which would result in the right-of-way <br />being 8 1/2 feet below standard. The City Enqineer is <br />recommending against it and is discussing the possible <br />improvement of Nadeau Road with the City Planner. <br />Council discussed the requests, and it was the <br />Council's consensus to call for the public hearing for <br />both vacation requests. However, the City <br />Administrator was directed to inform the developers <br />that the Council does not look favorably on the <br />requested vacation of Nadeau Road right-of-way, <br />therefore, the developers may wish to withdraw this <br />portion of their request. <br />Mr. Fahey intraduced the following resolution and moved <br />its adoption: <br />RESOLUTION NO. 90-9-421 - CALLING FOR A PUBLIC HEARING <br />ON OCTOBER 10, 1990 TO CONSIDER THE VACATION OF 15 FEET <br />OF THE CITY'S UTILITY EASEMENT WITHIN VACATED COUNTRY <br />DRIVE AS WELL AS 5 FEET OF THE NORTHERN PORTION OF <br />NADEAU ROAD RIGHT-OF-WAY PENDING THE OUTCOME OF THE <br />Page 14 <br />
