MINUTES <br />CITY COUNCIL <br />SEPTEMBER 26, 1990 <br />THAT THE DEVELOPER ENTER INTO A DEVELOPMENT AGREEMENT <br />WITH THE CITY PRIOR TO FINAL PLAT APPROVAL <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (4) Blesener, LaValle, Collova, Scalze. <br />Nays (0). <br />Resolution declared adopted. <br />RECESS At this point in the meeting, 9:18 P.M., Council took a <br />short recess. The meeting was reconvened at 9:27 P.M. <br />FINAL PUD, Scalze opened the Public Hearing on the final Planned <br />PLAN REVIEW, Unit Development, Plan Review and Lot Split for the <br />& LOT SPLIT Kandice Heights Commercial Park Phase II as submitted <br />by LEB Development. Scalze reported that the Planning <br />Commission has recommended approval based on the <br />developer working to address the concerns raised by the <br />City Planner. <br />The Planner reported that he has met with the <br />developer, his engineer and the City Engineer on the <br />Phase II building to resolve the concerns raised in his <br />report dated September 10, 1990. The developer has <br />agreed to provide a five foot curbed buffer for <br />landscaping along the northwest corner of the site. <br />The Planner explained that the developer is requesting <br />a 4 1/2 foot vacation of Nadeau Road right-of-way. <br />This would bring the road right-of-way to 42 feet in <br />width with a 28 foot wide bituminous. In return the <br />developer will grant the City 5 feet of utility and <br />snow storage easement on both sides of the road <br />right-of-way. Thus, the City will end up with an area <br />52 feet in width under City control. This situation is <br />acceptable to the City Planner and the City Engineer. <br />Scalze noted that the City will hold a public hearing <br />to consider the vacation on October 10th. Scalze felt <br />the request was reasonable and pointed out that the <br />developer will not be allowed the use of Nadeau Road, <br />which is mainly for access for the residential <br />properties to the west. <br />Scalze pointed out that this has been a Tax Increment <br />Financing project that the City undertook because of <br />the different ownership involved, and the need for <br />redevelopment of properties with existing homes. The <br />increment generated from the new buildings will be used <br />to purchase and demolish the existing homes. <br />Loren Brueggemann, LEB Development, presented a <br />Page 18 <br />
