MINUTES <br />CITY COUNCIL <br />OCTOBER 10, 1990 <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (5) Fahey, Blesener, Collova, LaValle, Scalze. <br />Nays (0). <br />Resolution declared adopted. <br />VACATION OF The Mayor opened the Public Hearing to consider the <br />COUNTRY DR. vacation of a portion of the Country Drive utility <br />EASEMENT & easement and a portion of the Nadeau Road right-of-way. <br />NADEAU ROAD <br />RIGHT-OF-WAY Fahey pointed out the recommendation from the City <br />Engineer for approval of the vacation of 4 1/2 feet o£ <br />the Nadeau Road right-of-way, thus reducing that <br />right-of-way to 42 feet in width, provided that the <br />developer grant the City 5 foot utility easements on <br />each side of the road. <br />The City Engineer agreed with the Mayor's outline, <br />pointing out that the effect of the 5 foot utility <br />easements is an area 52 feet in width under the City's <br />control. <br />The Engineer reported that the developer is also <br />requesting the vacation of a portion of the utility <br />easement which the City retained within the vacated <br />portion of the Country Drive right-of-way. The <br />Engineer reported that he has looked at the request to <br />ensure that there is ample room_for repairs to be done <br />to the City's watermain and sanitary sewer should the <br />need arise, and if the vacation is approved there will <br />still be 15 feet to the sanitary sewer and 25 feet to <br />the watermain. The Engineer felt these distances <br />adequate. Therefore, the City Engineer recommended <br />approval of the vacation request. <br />Blesener asked if it were correct that there was no <br />benefit or need for the City to retain the portion of <br />utility easement that the developer is requesting be <br />vacated. <br />The Engineer replied that this was correct. <br />There were no comments from the general public on this <br />matter. <br />Upon motion by Fahey, seconded by LaValle, the public <br />hearing was closed. <br />Blesener pointed out that if the City requires the 5 <br />foot utility easements on either side of Nadeau Road, <br />the City has met the requirements it needs. <br />The Administrator stated that this was correct, and, in <br />Page 3 <br />
