MINUTES <br />CITY COUNCIL <br />OCTOBER 10, 1990 <br />fact, the City has 2 feet over what it needs. The <br />result of the vacation is that property lines are <br />redefined. The Administrator reported that the City <br />Planner has reviewed the request and recommends <br />approval. <br />Scalze looked at approval of the request as a <br />compromise since the developer will not be allowed the <br />use of Nadeau Road. <br />Fahey asked if the future improvement of Nadeau Road <br />has been addressed. <br />The City Administrator reported that preliminary <br />estimates of the oost of improving Nadeau Road are <br />$23,000. The issue of the developer's share of this <br />cost is being addressed in Development Aqreement <br />negotiations. However, the improvement of Nadeau Road <br />has not been scheduled at this time. <br />The Administrator suggested that should the Council <br />decide to approve the vacation request, that approval <br />be contingent upon the following: subject to the <br />developer's purchase of the property; subject to <br />execution of a Development Agreement which will address <br />the improvement of Nadeau Road; and subject to the <br />deeding of the described easement areas over to the <br />City. <br />Mrs. Scalze introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 90-10-457 - VACATING TAAT PORTION OF <br />UTILITY EASEMENT WITHIN VACATED COUNTRY DRIVE AS WELL <br />AS THE PORTION OF NADEAU ROAD RIGHT-OF-WAY AS REQUESTED <br />BY LEB DEVELOPMENT CONTINGENT UPON THE DEVELOPER'S <br />PURCHASE OF THE PROPERTY, EXECUTION OF A DEVELOPMENT <br />AGREEMENT WHICH ADDRESSES THE IMPROVEMENT OF NADEAU <br />ROAD, AND DEEDING OF THE DESCRIBED EASEMENT AREAS <br />ADJACENT TO NADEAU ROAD RIGHT-OF-WAY OVER TO THE CITY <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (5j Scalze, Blesener, Collova, LaValle, Fahey. <br />Nays (o). <br />Resolution declared adopted. <br />KANDICE HGTS. Mr. Pat Pelstring, Business Development Services, <br />PHASE II - appeared before the Council and reviewed his report <br />DEVELOPMENT dated October 4, 1990., which was an overview of the <br />AGREEMENT proposed development agreement for Kandice Aeights <br />OVERVIEW Phase II. <br />Page 4 <br />
