MINUTES <br />CITY COUNCIL <br />OCTOBER 23, 1990 <br />out that other cities would not have allowed it. <br />Blesener pointed out that the recent upgrading of Payne <br />Avenue was due to the poor condition of the street and <br />in order to bring it up to City standards. <br />Fahey pointed out that at the time of the improvement <br />hearing, residents along Payne Avenue made the argument <br />that the condition of the street was due to <br />construction traffic. This was one of the reasons that <br />the City is participating in the cost of the <br />improvement through the use of surplus TIF funds, thus <br />reducinq the assessment necessary to the benefiting <br />property owners. <br />It was noted that Dean Paisley, 3078 Payne Avenue, has <br />filed a written objection to the assessment. <br />Scalze pointed out that prior to the initial <br />improvement of Payne Avenue, there were 3 or 4 property <br />owners that accessed their properties via gravel <br />driveways over a public road easement. Mr. Paisley was <br />one of them. Therefore, these property owners had a <br />number of years of use of their properties before any <br />assessment was levied. <br />A property owner along Payne Avenue indicated that <br />there is backfilling along curbing and some grading <br />work that still needs to be done. <br />The City Engineer replied that the City has not given <br />final approval to the project, and these corrections <br />would be made prior to that approval. <br />Mr. Fahey introduced the following resolution and moved <br />its adoption: <br />RESOLUTION N0. 90-10-477 - REJECTING THE DEAN PAISLEY <br />OBJECTION TO ASSESSMENT FOR IMPROVEMENT N0. 88-7 ON THE <br />BASIS THAT A SUBSTANTIAL PORTION OF THE IMPROVEMENT <br />COSTS ARE BEING BORNE BY TAE CITY AND ON THE BASIS THAT <br />THE APPRAISAL OF THE PROPERTY HAS INDICATED THAT THE <br />ASSESSMENT IS REASONABLE <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) Fahey, Scalze, Collova, LaValle, Blesener. <br />Nays (0). <br />Resolution declared adopted. <br />There was no one else from the general public present <br />wishing to comment on this matter. <br />Page 9 <br />
