MINUTES <br />CITY COUNCIL <br />OCTOBER 24, 1990 <br />PETITION Fahey reported that the City has received a petition <br />FOR from the Costa family for the improvement of DeSoto <br />IMPROVEMENT Avenue. Fahey noted that a valid petition needs to be <br />signed by 35% of the property owners involved. This <br />petition has the support of 33.1% of the property <br />owners. <br />Fahey reviewed the City Administrator's report dated <br />October 19th which explains the City's options which <br />include the City's participation in the petition, or <br />authorizing investigation of the project without <br />adequate petition. <br />Mrs. Scalze introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 90-10-486 - ORDERING THE PREPARATION OF <br />REPORT ON IMPROVEMENT OF DESOTO AVENUE BETWEEN LABOAE <br />ROAD AND ALLEN AVENUE BASED ON THE RECOMMENDATION OF <br />THE CITY ADMINISTRATOR AS OUTLINED IN HIS REPORT DATED <br />OCTOBER 19, 1990 <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (5) Scalze, Blesener, LaValle, Fahey, Collova. <br />Nays (O). <br />Resolution declared adopted. <br />The City Administrator estimated that the report would <br />be ready for Council review in 30 days. Once the <br />Council has reviewed the report the next step would be <br />to call for a public hearing on the project. <br />The City Attorney noted that without an adequate <br />petition, the Council needs a 4/5ths vote to approve <br />the improvement. With an adequate petition, only a <br />majority vote would be needed. <br />VARIANCE FOR Fahey opened the public hearing to consider the <br />BUILDING application submitted by Jerry Carle, Groundskeeper, <br />SIZE - for a variance to allow a building which exceeds <br />GROUNDSKEEPER maximum 30% accessory building size. Fahey noted that <br />the Planning Commission and City Planner have <br />recommended against approval of the variance. <br />There was no one present from the general public <br />wishing to comment on this matter. <br />Upon motion by Scalze, seconded by LaValle, the public <br />hearing was closed. <br />Page 12 <br />
