Fahey pointed out that if the <br />property to the north can be reasonably acquired so <br />that the road can be put through, he felt this is the <br />way the project should go. Fahey pointed out that the <br />Costa family would gain two additional lots under that <br />proposal. Fahey stated that if the developer cannot <br />negotiate for the purchase of the easements to the <br />north within 30 days, he would be in favor of <br />condemnation. <br />Jim Michaud stated that everyone on Allen is opposed to <br />Costa Lane going north. <br />Clarence Bruehn stated that everyone on Vanderbie is <br />opposed to Costa Lane connecting with Vanderbie. <br />DeBace again requested that the Council act on the <br />preliminary plat before it. <br />Fahey stated that if the preliminary plat is approved, <br />the City has lost its leverage with the developer to <br />get Costa Lane through to Allen Avenue. <br />Peter Costa pointed out that his family is giving up <br />their share of land for road easement, and felt that if <br />the properties to the north wish to develop, they, too, <br />should give up their share of road easement without <br />compensation. <br />Scalze asked who would pay the cost of condemnation if <br />that procedure is necessary. <br />DeBace replied that the cost of condemnation would be <br />included in the project costs which are assessed back <br />against the benefiting properties. <br />Collova felt that Costa Lane should be run through to <br />Allen Avenue at this time pointing out that the <br />property owners to the north would have a hard time <br />running the road north in the future if it is not done <br />as part of this larger project. <br />Costa stated that if Costa Lane is developed entirely <br />on the Costa property, the improvement costs would be <br />paid by his family. However, Costa stated that he was <br />not willing to pay for easements to the north. <br />DeBace again requested preliminary plat approval, <br />pointing out that this is necessary so that final plat <br />approval can be requested for the lots along DeSoto. <br />Page 7 <br />
