MINUTES <br />CITY COUNCIL <br />DECEMBER 12, 1990 <br />GRAND PRE' Fahey reported that Bellaire Properties has reviewed <br />RETROFITTING the proposed retrofitting agreement for the Grand Pre' <br />AGREEMENT Apartments. They have objected to the provisions which <br />allow the City to do the retrofitting should it not be <br />done by the owner. They are also objecting to paying <br />attorney's fees in putting together the agreement, <br />Fahey pointed out that the retrofitting will be a <br />significant improvement since the building will be <br />brought up to Code and much safer from a public safety <br />standpoint. Fahey pointed out that the City has other <br />means of requiring the building be brought up to Code <br />if the agreement is not honored. Therefore, Fahey <br />stated that he supported the agreement with the <br />deletion of the two provisions that Bellaire Properties <br />is objecting to. <br />The City Attorney explained that the agreement as <br />drafted provides for three things: first, if Bellaire <br />Properties does not do the retrofitting, the City could <br />have the work done; secondly, the costs of retrofitting <br />and costs related to the agreement and other things <br />could be passed on to the property owner; and third, <br />that the document is recordable. Elimination of the <br />first two provisions makes the document recordable and <br />also incorporates into the document Bellaire <br />Properties' letter of November. <br />Fahey pointed out that the November letter outlines the <br />specifics of what Bellaire Properties agrees to do. <br />Mr. Blesener introduced the following resolution and <br />moved its adoptions <br />RESOLUTION N0. 90-12-548 - APPROVING THE GRAND PRE' <br />RETROFITTING AGREEMENT BETWEEN THE CITY OF LITTLE <br />CANADA AND BELLAIRE PROPERTIES AS SUBMITTED BY BELLAIRE <br />PROPERTIES AND AUTHORIZING THE MAYOR AND CITY <br />ADMINISTRATOR TO SIGN THE AGREEMENT ON BEHALF OF THE <br />CITY <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) Blesener, Scalze, Collova, LaValle, Fahey. <br />Nays (0). <br />Resolution declared adopted. <br />RECYCLING The Council reviewed the proposed ordinance submitted <br />ORDINANCE by the City Attorney providing for mandatory recycling <br />for residential dwelling units. It was pointed out <br />that the ordinance provides for mandatory recycling at <br />multiple-family dwellings and requires the haulers to <br />report the amount of recyclable tonage picked up.
