MINUTES <br />CITY COUNCIL <br />DECEMBER 26, 1990 <br />classes of licenses unless there is a maximum on the <br />number of B licenses, but no cap on the A licenses. <br />Council discussed the A license versus B license, and <br />the City Attorney suggested that an inventory should be <br />done to classify the existing liquor establishments in <br />the City. <br />Blesener estimated that the City has four B licenses <br />issued and one A license by the standards in the <br />proposed Ordinance. Blesener suggested that the <br />classifications would be meaningless without some <br />limits established. <br />Blesener suggested that Section 703.110 and 703.130 <br />were contradictory. Blesener also pointed out the <br />differing closing times for businesses selling <br />intoxicating versus non-intoxicating liquor as provided <br />in Section 703.150. <br />Council instructed the City Attorney to incorporate the <br />changes to the proposed Ordinance as discussed. Once <br />this has been done, City staff should submit the <br />proposed Ordinance to the liquor businesses in the <br />City, as well as various organizations typically <br />requesting 2-day permits, for their comments. <br />ADULT USE The City Attorney reviewed his report dated December <br />ORDINANCE 20, 1990 regarding the proposed Adult Use Ordinance. <br />Fahey noted that the proposed Ordinance does not <br />address pawn shops. Fahey reported that he was <br />informed that the pawn shop which recently located in <br />the City did so because the City does not regulate the <br />amount of time that merchandise must be held before it <br />is sold. Most cities require pawn shops to hold <br />merchandise for a period of one year. Fahey felt that <br />the City should regulate this activity, otherwise it <br />might end up with a series of pawn shops running up and <br />down Rice Street. <br />The City Attorney reported that he would determine <br />whether or not the City has the authority to regulate <br />pawn shops by requiring that merchandise be held for a <br />period of time before it can be sold. <br />Mr. Blesener introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 90-12-565 - CALLING FOR A MORATORIUM ON <br />THE ISSUANCE OF BUSINESS LICENSES FOR PAWN SHOPS FOR A <br />PERIOD OF SIX MONTHS OR ADOPTION OF AN ORDINANCE <br />REGULATING THIS ACTIVITY, WHICHEVER IS SOONER <br />Page 14 <br />
