MINUTES <br />CITY COUNCIL <br />JANUARY 23, 1991 <br />on which the encroachment occurs has no purpose for <br />present or future utilities. The Administer pointed <br />out that as the watermain along Rice Street extends <br />northward, the easement tapers and there is the <br />possibility the additional right-of-way is necessary <br />from Kath Bros. for the watermain at the northwestern <br />edge of their property. <br />The City Administrater recommended that the City <br />Council initiate a public hearing to consider the <br />vacation of that portion of Woodlynn Avenue <br />right-of-way on which the Kath Bros. fuel tanks are <br />encroaching. However, the Administrator pointed out <br />that should the Council initiate the action, it would <br />take a 4/5ths vote of the Council to approve the <br />vacation. <br />Mr. Blesener introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 91-1-31 - CALLING FOR A PUBLIC HEARING <br />ON WEDNESDAY, FEBRUARY 27, 1991 AT 7:30 P.M. TO <br />CONSIDER THE VACATION OF A PORTION OF THE WOODLYNN <br />AVENUE RIGHT-OF-WAY <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Blesener, LaValle, Scalze, Collova, Hanson. <br />Nays (0). <br />Resolution declared adopted. <br />Blesener suggested that the City Engineer and City <br />Administrator work with Kath Bros. to resolve the <br />watermain easement issue on the northern portion of the <br />Kath property. Mr. Kath indicated his willingness to <br />cooperate with the City regarding the matter. <br />CABLE TV The City Attorney presented to the Council a proposed <br />ORDINANCE ordinance amending the City's Cable TV Franchise <br />Agreement. <br />Blesener explained that the ordinance addresses the <br />transfer of public access from the Company to the Cable <br />Commission and Access Corporation. <br />Mr. Blesener introduced the following ordinance and <br />moved its adoption: <br />ORDINANCE N0. 343 - AN ORDINANCE AMENDING CERTAIN <br />SECTIONS OF N0. 196, FRANCHISE ORDINANCE, OF THE CITY <br />OF LITTLE CANADA <br />The foregoing ordinance was duly seconded by Scalze. <br />Ayes (5) Blesener, Scalze, Hanson, LaValle, Collova. <br />Nays (0).
