MINUTES <br />CITY COUNCIL <br />February 13, 1991 <br />SCHROEDER The Administrator reviewed the Schroeder Milk Agreement <br />which provides for the connection of Schroeder Milk, <br />which is located in Maplewood, to Little Canada's water <br />system. Connection charge to Schroeder Milk is <br />$108,425. The agreement has been submitted to <br />Schroeder Milk for their signature, and the terms of <br />the agreement are essentially what has been negotiated <br />with that firm. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 91-2-60 - APPROVING THE SCHROEDER MILK <br />WATER CONNECTION AGREEMENT AND AUTHORIZING THE MAYOR <br />AND CITY ADMINISTRATOR TO EXECUTE THE AGREEMENT ON <br />BEHALF OF THE CITY <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) LaValle, Scalze, Collova, Blesener, Hanson. <br />Nays (0). <br />Resolution declared adopted. <br />GRAND PRE' The City Administrator reported that in negotiating <br />RETROFITTING the agreement for the retrofitting of the Grand Pre' <br />~GREEMENT Apartment complex, the City had expected to have the <br />agreement recorded against the property. However, the <br />property owner is unwilling to turn over the necessary <br />documents so that the agreement can be recorded. The <br />Administrator indicated that the matter may not be of <br />great concern since the owner has no intention of <br />sellinq the property and the retrofitting of the <br />building is progressing well. Also, the entire <br />building is being sprinkled which is more than what was <br />initially agreed to. The Administrator reported that <br />under these circumstances the City Attorney agreed that <br />there is no real concern in not recording the <br />retrofitting agreement. <br />Mr. Blesener introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 91-2-61 - ACCEPTING THE RECOMMENDATION <br />OF THE CITY ATTORNEY AND CITY ADMINISTRATOR AND <br />RESCINDING THE REQUIREMENT OF FILING AND RECORDING THE <br />GRAND PRE' RETROFITTING AGREEMENT AND ACCEPTING THE <br />LETTER OF BELLAIRE PROPERTIES REGARDING THEIR <br />INTENTIONS REGARDING THE PROPERTY <br />The foregoinq resolution was duly seconded by LaValle. <br />Ayes (5) Blesener, LaValle, Scalze, Hanson, Collova. <br />Nays (o). <br />Resolution declared adopted. <br />Page 14 <br />
