MINUTES <br />CITY COUNCIL <br />February 13, 1991 <br />The City Attorney reported that the license fee must be <br />reasonably related to investigative and administrative <br />costs that a city might typically incur for this type <br />of use. The Attorney stated that this type of business <br />does generate much more investigative and <br />administrative time. However, he was not prepared to <br />recommend a fee and suggested that a survey be done to <br />determine what other cities are charging. <br />Blesener suggested that as a temporary measure the fee <br />be set at $10,000 until a survey can be done. <br />The City Attorney pointed out that there are actually <br />two fees involved, one for principle adult use <br />businesses and the other for accessory adult use <br />businesses. <br />Blesener asked if video stores that had adult movie <br />sections would fall under the definition of an adult <br />use business. <br />The City Attorney stated that he would research that <br />issue. <br />Collova suggested that the Council establish an adult <br />use business license fee at this time, noting that <br />based on further research, the fee can be amended. <br />Mr. Collova introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 91-2-52 - ESTABLISHING AN LICENSE FEE OF <br />$10,000 FOR BOTH THE PRINCIPLE ADULT USE BUSINESS AND <br />ACCESSORY ADULT USE BUSINESS AS DEFINED IN THE CITY'S <br />ADULT USE ORDINANCE <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (5) Collova, Blesener, Scalze, LaValle, Aanson. <br />Nays (0). <br />Resolution declared adopted. <br />It was noted that City Staff will conduct a survey to <br />determine adult use business license fees in other <br />cities and whether or not other cities consider video <br />stores with small adult sections as adult use <br />businesses. <br />GAMBLING Council reviewed the proposed gambling ordinance <br />ORDINANCE revision submitted by the City Attorney which will <br />REVISION incorporate recent State Law changes into the City~s <br />Code. <br />Page 4 <br />
