MINUTES CITY COUNCIL February 13, 1991 The City Attorney reported that the license fee must be reasonably related to investigative and administrative costs that a city might typically incur for this type of use. The Attorney stated that this type of business does generate much more investigative and administrative time. However, he was not prepared to recommend a fee and suggested that a survey be done to determine what other cities are charging. Blesener suggested that as a temporary measure the fee be set at $10,000 until a survey can be done. The City Attorney pointed out that there are actually two fees involved, one for principle adult use businesses and the other for accessory adult use businesses. Blesener asked if video stores that had adult movie sections would fall under the definition of an adult use business. The City Attorney stated that he would research that issue. Collova suggested that the Council establish an adult use business license fee at this time, noting that based on further research, the fee can be amended. Mr. Collova introduced the following resolution and moved its adoption: RESOLUTION NO. 91-2-52 - ESTABLISHING AN LICENSE FEE OF $10,000 FOR BOTH THE PRINCIPLE ADULT USE BUSINESS AND ACCESSORY ADULT USE BUSINESS AS DEFINED IN THE CITY'S ADULT USE ORDINANCE The foregoing resolution was duly seconded by Blesener. Ayes (5) Collova, Blesener, Scalze, LaValle, Aanson. Nays (0). Resolution declared adopted. It was noted that City Staff will conduct a survey to determine adult use business license fees in other cities and whether or not other cities consider video stores with small adult sections as adult use businesses. GAMBLING Council reviewed the proposed gambling ordinance ORDINANCE revision submitted by the City Attorney which will REVISION incorporate recent State Law changes into the City~s Code. Page 4
