MINUTES <br />CITY COUNCIL <br />February 27, 1991 <br />DeBace pointed out that the City is requiring the Costa <br />Family to put up a deposit to cover these costs. <br />Blesener pointed out that the City needs to discuss how <br />it will pay for its share of road costs associated with <br />the improvement of DeSoto Avenue. Blesener stated that <br />he understands that the developer will request the City <br />to bond for the project, however, the City has to <br />figure out how it will finance its share. <br />The City Administrator reported that the DeSoto <br />feasibility study will identify the costs involved. <br />ADULT USE Scalze pointed out that the issue of a license fee for <br />BUSINESSES adult use businesses was tabled until this meeting. <br />Staff has surveyed other cities to determine fees being <br />charged, and it does not appear that many other cities <br />have addressed this issue. Scalze asked how much the <br />City could legally charge as an adult use license fee, <br />and also pointed out the issue of video rental stores <br />which may have adult sections. <br />The City Attorney pointed out that under the City's <br />present sauna ordinance, a license fee of $10,000 has <br />been established. The Attorney stated that he did not <br />believe the sauna ordinance was inconsistent with the <br />adult use ordinance, and should continue. The City has <br />had no applicants for a sauna license and no one has <br />challenged the City's sauna license fee. The City <br />Attorney did not believe a similar license fee for <br />principle adult use businesses would be inconsistent or <br />unreasonable. However, the Attorney felt the accessory <br />adult use business was different and recommended a$25 <br />license fee for these businesses, such as video rental <br />stores. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 91-2-73 - AMENDING RESOLUTION NO. <br />91-2-52 AND ESTABLISHING A LICENSE FEE OF $10,000 FOR <br />PRINCIPLE ADULT USE BUSINESSES AND A LICENSE FEE OF $25 <br />FOR ACCESSORY ADULT USE BUSINESSES <br />The foregoinq resolution was duly seconded by Blesener. <br />Ayes (4) LaValle, Blesener, Scalze, Collova. <br />Nays (0). <br />Resolution declared adopted. <br />Page 5 <br />
