MINUTES <br />CITY COUNCIL <br />February 27, 1991 <br />LIQUOR The City Attorney submitted a revised Liquor Ordinance <br />ORDINANCE as well as correspondence dated February 22, 1991 <br />detailing changes that were made to the proposed <br />ordinance due to discussions that were held with the <br />owners of liquor businesses in the City. <br />The Attorney reviewed Sections 702.060 and 703.090 <br />regarding eligibility of applicants for liquor <br />licenses, and it was the consensus of the Council to <br />retain State requirements. Sections 702.090, 703.180, <br />703.120 (4) and 703.140 (2) where amended as proposed <br />to correct typographical errors. <br />Council discussed amending the Ordinance to allow <br />on-sale liquor establishments to be open on Christmas <br />Day, which is consistent with State Law. While Collova <br />strongly opposed this revision, the consensus of the <br />Council was to allow it consistent with State Law, with <br />what neighboring cities allow, and with what the <br />majority of the on-sale license holders in the City <br />want. <br />Chapter 706 was discussed next, and it was pointed out <br />that the City's existing ordinance already provides for <br />Entertainment License and should continue to do so. <br />The City Attorney pointed out that if a"Dancing and <br />Entertainment License" is not provided for, such <br />activity would be prohibited. <br />The City Attorney reported that Sections 702.070 (9) <br />and (10) and 703.100 (8) are being revised in a manner <br />consistent with State Law. <br />The Attorney reported that it was suggested at the <br />meeting with liquor businesses, that the Ordinance <br />provide that liquor license fees be established by <br />Council Resolution rather than Ordinance. This is <br />allowable, however, State Law requires that a public <br />hearing be held on any proposed license increase with <br />mailed notice of the hearing at least 30 days prior to <br />the hearing date. <br />LaValle pointed out that it would be more <br />cost-effective to have liquor license fees established <br />by resolution. Council agreed. <br />Next discussed was evacuation of premises by 1:30 A.M. <br />The City Attorney pointed out that State Law prohibits <br />the sale of liquor after 1 A.M., but does not say when <br />patrons must leave the premises or when consumption <br />must stop for on-sale. The City's present Code calls <br />for evacuation of premises by 1:30 A.M. for <br />Page 6 <br />
