MINUTES <br />CITY COUNCIL <br />February 27, 1991 <br />non-intoxicating, but does not address intoxicating. <br />The Attorney reported on one problem that occurred in <br />the City because of this inconsistency and suggested <br />that the new Ordinance address the issue. <br />It was the consensus of the Council that a 1:30 A.M. <br />evacuation time should be established for both on-sale <br />intoxicating and non-intoxicating liquor in the new <br />Ordinance. <br />The City Attorney next discussed Sunday Sales and it <br />was the consensus of the Council that the language <br />governing Sunday Sales should be consistent with State <br />Law. <br />Hours and days of sale were discussed, and the <br />Council's consensus was to make the City~s Ordinance <br />consistent with State Law reqarding hours of sale, <br />however, the consensus was to continue to prohibit <br />off-sale of liquor on January ist and July 4th as is <br />currently prohibited under the City's existing Liquor <br />Ordinance. <br />The City Attorney reported that currently the City has <br />Surety Bonds, in addition to Certificates of Liquor <br />Liability insurance, for all liquor licenses that are <br />in effect. Beginning with the next licensing period, <br />Surety Bonds will no longer be required. <br />Council instructed the City Attorney to amend Section <br />703.110 changing the population requirement to 20,000 <br />residents. <br />Next discussed was Section 703.160 Restrictions on <br />Purchase and Consumption, specifically as applies to <br />picnics in City parks were there is consumption of <br />liquor. It was the consensus of the Council to add the <br />wording "or Council and/or Park and Recreation Director <br />approval" to the end of paragraph (2) to address this <br />issue. <br />The next area discussed was the establishment of Class <br />A and B on-sale liquor licenses. Scalze pointed out <br />that the City had previously obtained two additional <br />on-sale liquor licenses from the Legislature which were <br />requested as economic development tools. <br />LaValle reported that the liquor owners in the City do <br />not want the two-tiered license system and also <br />expressed concern about the 2 additional on-sale <br />licenses that are available in addition to the license <br />previously held by Dick and Mary's. <br />Page 7 <br />
