MINUTES <br />CITY COUNCIL <br />March 27, 1991 <br />Leonard Schmieg, the potential buyer, stated that he <br />needs the additional building, which he estimated would <br />cost him $40,000 to construct. <br />Blesener stated that he understands Malsam's position, <br />but pointed out that if a$40,000 building is <br />constructed on the property, it may make the site too <br />expensive for a future buy-out. Blesener stated that <br />he would support the proposal if the appearance of the <br />buildings could be changed to conform to the <br />development that is occuring. <br />Malsam again pointed out that this was not feasible. <br />Malsam suggested that the City purchase his property <br />and that TIF funds could be used for this purpose. <br />Malsam stated that if the City will not let him sell <br />his property, then the City should do something for <br />him. <br />The City Administrator suggested that working with <br />Business Development Services, he look at the numbers <br />on Phases II and III to determine if there will be any <br />TIF surpluses that could be used to purchase the <br />structures in advance subject to statutory requirements <br />governing the use of TIF monies. The Administrator <br />suggested that he could have this information in a <br />couple of weeks. If a buy-out occurred, the <br />Administrator suggested that the City may then have to <br />give the developer some direction as to where the next <br />building phase occurs. <br />Malsam stated that he would like a yes or no answer <br />from the Council tonight on the proposal before them. <br />Scalze stated that to be approved the proposal had to <br />meet the requirements of the PUD, and the reason the <br />property was rezoned to PUD was so the City could <br />require a certain look to development in that area. <br />Scalze felt that the Malsam proposal had to look like <br />it fit into the area. <br />Malsam again pointed out that additional requirements <br />would make the possibility of a future buy-out <br />unfeasible. <br />Blesener stated that he was not comfortable in acting <br />on the proposal at this time, and suggested that the <br />matter be tabled pending information from the City <br />Administrator on possible TIF surpluses. <br />The City Administrator suggested that Phases I, II and <br />III be looked at as well as potential acquisition costs <br />to determine if the City can afford to purchase the <br />properties. If the City does purchase the sites, it <br />would be in the City's best interests to recover that <br />Page 13 <br />
