MINUTES <br />CITY COUNCIL <br />March 27, 1991 <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (4) Scalze, Blesener, Collova, Hanson. <br />Nays (0). <br />Resolution declared adopted. <br />PUD - Hanson opened the public hearing to consider the <br />MARK MALSAM application for Planned Unit Development for conversion <br />PROPERTY of existing residence and garage at 2825 Country Drive <br />2825 COUNTRY to business use as well as construction of another <br />DRIVE building to support the business. <br />Scalze pointed out that the Planning Commission <br />recommended on a 5 to 2 vote to deny the application. <br />Their concern was what happens with this type of <br />development in the middle of a phased-in development. <br />Scalze pointed out that the City has worked hard and <br />has come a long way in the development of this area. <br />Scalze felt that the City had the right and duty to see <br />that the entire phased-in plan for the area comes to <br />fruition. <br />Mark Malsam, owner of 2825 Country Drive, reported that <br />he has a buyer for his property. Malsam reported that <br />the Planning Commission's concern was with the <br />appearance of the buildings on his property and they <br />asked that the buyer work with the City Planner to see <br />if cosmetic changes could be made to blend the <br />buildings in with the phased-in development which is <br />occurring. This cannot be done. Malsam pointed out <br />that if the City requires too much money be put into <br />his property, it will make a future buy-out unfeasible. <br />Malsam reported that he has a buyer for his property <br />and he wants out. Malsam stated that the property is <br />zoned for the use proposed. If the City wishes to buy <br />the property and have total control over it, that was <br />acceptable to him. Malsam pointed out that there is no <br />established timeframe or guarantees that the proposed <br />phased-in development will occur on his property, and <br />neither the City nor the developer has tied up his <br />property. Malsam pointed out the traffic situation on <br />Country Drive, and does not believe this is a good area <br />to raise a young family. <br />Scalze agreed that the property was zoned commercial <br />and pointed out that the property was rezoned by the <br />City to address the concerns of the property owners who <br />felt their properties could not be sold as residential. <br />However, Scalze stated that she had to look at the <br />long-term and she did not see the proposal before the <br />Council this eveninq as fitting into the puzzle. <br />Page 11 <br />
