MINUTES <br />CITY COUNCIL <br />March 27, 1991 <br />Welch was proposing a swale to get water to the catch <br />basins. <br />Welch pointed out that each proposed lot has drainage <br />easements along the lot lines and agreed that run-off <br />could be directed to the catch basins with a perimeter <br />ditch system. <br />Blesener stated that he had a problem with the 20-foot <br />drop in elevation. Blesener pointed out that run-off <br />will have to go over this drop to get to the catch <br />basins. Blesener was concerned with the bank washing <br />out. <br />Welch pointed out that the development agreement will <br />require that the bank be hay-baled and proper <br />precautions taken during construction so that the bank <br />will not wash out. Welch also pointed out that there <br />is a 5% change in grade on the site running from the <br />north to the south. <br />Joe Fasciana, Jackson Street resident, asked where the <br />easement was so that Welch could connect his proposed <br />street with Jackson. Fasciana reported that he granted <br />a private easement to his brother for access at the end <br />of Jackson, but that easement was private and not <br />public. <br />Welch disagreed and reported that there is an existing <br />easement into the area. <br />Fasciana disputed the existence of the easement. <br />Fasciana also expressed concern that the developer has <br />never met with the neighbors to discuss his proposal. <br />Donna Johnson, 61 LaBore Road, pointed out that the <br />preliminary plat was denied by the Planning Commission. <br />Johnson reported that the neighbors are not opposed to <br />a good residential development, but are against a <br />proposal being railroaded through. Johnson reported <br />that she has done some research at the County <br />Recorder's office and has found there is no easement <br />over the Joseph Fasciana property and no dedication to <br />the City giving Mr. Welch road access into his property <br />from Jackson Street. The only easement that exists is <br />from Mr. Fasciana to his neighbors. <br />Johnson reported that the concerns of the neighborhood <br />are that the plat as proposed does not work because <br />there is no access over the Fasciana property, that the <br />proposal needs to be given to the Planning Commission <br />with ample time to study it, that there was no <br />neighborhood meeting on the proposal.
