MINUTES <br />CITY COUNCIL <br />MAY 22, 1991 <br />Scalze pointed out that Mr. Bentz's business is a pawn <br />shop and would be governed by the proposed Pawn Shop <br />Ordinance when that Ordinance is adopted. <br />Bentz asked if he were licensed as a gun dealer, if he <br />could purchase and sell weapons, but not pawn them. <br />LaValle pointed out that Mr. Bentz's suggestion would <br />be to circumvent the Pawn Shop Ordinance by obtaining a <br />Federal Firearms License. <br />Bentz reported that he does do a business in handguns, <br />although he does not get involved in other types of <br />weapons. <br />Scalze stated that the Pawn Shop Ordinance as proposed <br />was acceptable to her. Blesener stated that he would <br />accept the Ordinance including the recommendations of <br />the Sheriff's Department. <br />LaValle reported that he had more concern with the <br />pawning of handguns than the sale of handguns in view <br />of the stringent Federal and State regulation of <br />handgun sale~. <br />Blesener suggested that the Ordinance continue to <br />prohibit handguns which will force anyone interested in <br />the sale of guns to request a handgun sale license. <br />Scalze expressed concern about the sale of used guns. <br />It was pointed out that State Law requires a 3-day <br />waiting period in the purchase of a handgun as well as <br />a Sheriff's Department background check, which can take <br />as long as 7 to 10 days. <br />With regard to background checks, the City <br />Administrator reported that the City would have to <br />decide how detailed these checks should be. The <br />Administrator reported that the Sheriff's Department <br />has the ability to do a fairly broad background check, <br />which includes more detailed financial information than <br />a standard credit report. <br />LaValle asked if the same background check should be <br />done on an applicant for a pawn shop license as is done <br />on an applicant for a liquor license. <br />Scalze felt the two licenses were totally different, <br />and felt a more extensive background check should be <br />done on the applicant for pawn shop license, in view of <br />the risk to pawn shops of taking in stolen qoods. <br />Page 11 <br />
