MINUTES <br />CITY COUNCIL <br />MAY 22, 1991 <br />Collova asked how Mr. Welch can be expected to deed <br />over the property that was to have been the park charge <br />for the Yorkton Industrial Park. <br />The City Administrator reported that based on County <br />section maps it appears this property is part of Mr. <br />Welch's parcel. Therefore, it was felt that the City <br />had an opportunity to collect the property that should <br />have been previously deeded over to the City. <br />Mr. Rue, Rue Plastics, reported that there is a holdinq <br />pond attached to his property which he indicated he did <br />not want to pay property taxes for. <br />The City Administrator replied that it appears from his <br />research of past Council meeting minutes, that it was a <br />conscience decision of the Council to leave the ponding <br />area as a drainage easement in order to keep the <br />property on the tax rolls. However, the Administrator <br />felt that Mr. Rue had valid concerns, and the property <br />as a storm water retention pond is of no worth to him. <br />Donna Johnson, property owner in the area, reported <br />that Mr. Welch has not contacted Mr. Fasciana about <br />obtaining an easement for road right-of-way purposes. <br />Johnson stated that this contact needs to be developed <br />between these two individuals before a preliminary plat <br />can be approved. <br />Property owners in the area asked how long they would <br />have to keep coming back on this matter before a <br />decision is made. <br />The City Attorney reported that the Ordinance does not <br />provide any specific time during which the Council must <br />take action on a preliminary plat application. The <br />Attorney suggested, however, that the Council may want <br />to impose a time limit. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 91-5-172 - TABLING ACTION ON THE YORKTON <br />RIDGE WEST PRELIMINARY PLAT UNTIL THE JUNE 26, 1991 <br />COUNCIL MEETING AND INSTRUCTING STAFF TO CONTACT THE <br />DEVELOPER AND DETERMINE IF AE WILL BE PREPARED TO <br />PRESENT THE PRELIMINARY PLAT AT THAT TIME, AND IF NOT, <br />THE COUNCIL WILL TAKE ACTION TO DENY THE PRELIMINARY <br />PLAT AS WELL AS INFORM TAE NEIGHBORING PROPERTY OWNERS <br />OF THIS FACT <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (5) LaValle, Blesener, Collova, Scalze, Hanson. <br />Nays (0).
